I am writing to request an internal review of Department of Health and Social Care's handling of my FOI request 'NHS Funding Allocation and Expenditure' FOI-1473233.

Legal Failures:

Failure to Provide Information or valid citation of exemption: The response dated 26th October 2023 indicated that an attachment containing the requested information was included. However, no such attachment was present. Furthermore there was no citation to explain why the information requested was not present. This is a failure to comply with Section 1 of the Freedom of Information Act 2000, which mandates that public authorities must provide the information requested.

Non-Legal Failures:

Inadequate Communication: The response did not clarify the absence of the attachment or offer an alternative means to access the information requested. This lack of clear communication undermines the spirit of transparency that the Freedom of Information Act aims to uphold.

Errors and Inconsistencies:

Misleading Information: The email response explicitly stated that an attachment was included, which was not the case. This is misleading and creates confusion.

Public Interest Statements:

Any reasons for not providing the information must be weighed against the public interest in releasing such information which you clearly failed to do.

1 Transparency in Public Spending: The information requested pertains to the allocation and utilisation of public funds in NHS trusts. This is of significant public interest as it directly impacts the quality and availability of healthcare services.

2 Accountability: Understanding the reporting requirements for NHS trusts helps to ensure that public funds are being used effectively and responsibly, thereby holding these organisations accountable.

I kindly request that you expedite this internal review and rectify the aforementioned issues as soon as possible. I look forward to receiving the missing information, along with an explanation for the errors and inconsistencies in the original response.
