This is a request under the Freedom of Information (Scotland) Act 2002. I would be grateful if you could supply the following information in digital format:

I wish to know whether all in-patients have access within their room or ward, whenever needed, to the following disabled facilities; and if not, the number of beds where patients do not have ready access at all times, broken down by hospital and ward, noting the ISD Scotland classification of each.

1) Wheelchair accessible toilets
2) Toilets at a suitable height for wheelchair users
3) Bars or hand grips in the toilets

We refer to our email of 1^st September, shown below, asking for
clarification of which ISD classification you are referring to in your
request for information of 29^th August, shown at the start of this email
trail.

 

We have not yet received a response from you. We are sending you this
reminder as recommended by Section 5.5.3 of the Scottish Ministers’ Code
of Practice on the Discharge of Functions by Scottish Local Authorities
under the Freedom of Information (Scotland) Act 2002 (FOISA), as a period
of 20 working days has now passed since we asked for clarification, and
must remind you that, until we receive clarification, we are unable to
proceed with your request.   Please note that if after a further 20
working days we still have not received a reply from you then, we will
write to you again to inform you that we consider your request to be
closed.

 

Section 15(1) of FOISA requires us to “provide advice and assistance to a
person who proposes to make, or has made, a request for information to it”
and we will always do our best to help you with your request. Would you be
able, please, to describe whether you mean ISD codes in relation to the
disabled facilities, the hospital or the wards, we will be more able to
proceed with your request and supply the information you require?

and Clyde (NHSGGC).

assisted us on your behalf with this FOI request, has suggested that you

NHSGGC does not keep a database of this information but, we have provided
a general response to your questions, which is shown below.

 

Do all in-patients have access within their room or ward, whenever needed,
to the following disabled facilities:

1)   Wheelchair accessible toilets Yes, all sites

2)   Toilets at a suitable height for wheelchair users Yes, all sites

3)   Bars or hand grips in the toilets Yes, in all assisted-access
toilets

4)   Emergency cords in the toilets Yes, in all assisted-access toilets

5)   Disabled showering facilities Yes, in all new-build areas. We are
unable to confirm that this is the case in some of your older buildings.

6)   Emergency cords beside beds In most cases, yes

7)   Automatic doors between beds and toilets We are uncertain what this
means. Please refer to the main text of our response email.

8)   Automatic doors between beds and showering facilities Please see our
response to your Q7

9)   Hoists All wards will have access to hoists. This is a requirement
of the Health and Safety at Work Act.

 

In order to provide this information as requested, it would require a
review of all individual facilities on all sites. We estimate that the
cost of providing this information would exceed the cost threshold set out
in Fees Regulations (currently £600). Section 12 of FOISA provides that a
public authority is not obliged to comply with a request where it
calculates that the cost of complying would exceed this limit. On this
occasion we are therefore unable to provide the information for this part
of your request.

 

Under section 15 of FOISA we also have a duty to provide reasonable advice
and assistance under the Act.  I would therefore recommend that you make
contact with me to discuss whether there is an alternative approach to
your request, or consider whether you are able to submit a narrower or
amended request, that would enable us to provide information within the
cost limits.

 

You will note that we are unsure what you mean by your questions 7 and 8,
and would be grateful for your clarification of these. We should however
point out that, again, we would only be likely to be able to provide a
general response to them, as explained.

 

If you require any clarification about this letter please contact us in
the first instance.

 

If you are not satisfied with our response to your request, you have a
right to request a review of this decision within 40 working days of
receiving this response.  The procedure for consideration of a review is
detailed in the attached note. The note also describes your right to
pursue the matter with the Scottish Information Commissioner if, following
a request for review, you remain dissatisfied with the decision of NHS
Greater Glasgow and Clyde.  If following appeal to the Scottish
Information Commissioner you still remain dissatisfied with the outcome,
you have a right of appeal to the Court of Session on a point of law
against the decision of the Scottish Information Commissioner.
