New road common land query 2
Dear South Lakeland District Council,
Is the north side of new road which is also commons land insured for vehicles which are currently parking on this land.
If this is not the case are the council not therefore being negligent by allowing vehicles to drive on and park on this land without insurance and how is this being justified.

I am writing in respect of your recent enquiry for information held by the
Council under the provisions of the Freedom of Information Act. You asked
the following:
Is the north side of new road which is also commons land insured for
vehicles which are currently parking on this land.
If this is not the case are the council not therefore being negligent by
allowing vehicles to drive on and park on this land without insurance and
how is this being justified.
I can confirm the following:
The position is that those businesses on the North side are likely to have
acquired legal rights to drive over and park on the land due to long use.
If that is the case, that use is legal.
Insurance covers the council against any claim/incident where it can be
found legally liable. This would generally include incidents arising out
of those vehicles lawfully using the land.
You are free to use any information supplied for your own personal use.
However, any other type of re-use, for example, by publishing the
information or issuing copies to the public will require the permission of
the copyright owner.
If you are not satisfied with the outcome of your FOI request, you have
the right to ask us to review our handling of your request. Any request
