Re: Freedom of Information Request – Our ref: 2021-15

We refer to your recent request:

“Please provide the following:

A) A full copy of the 'evaluation matrix' used in selecting the site at St
Anne Street for the new Police HQ.

B) A full copy of the feasibility study used to select the site.

Furthermore,

C) Has the PCC Jane Kennedy ever undertaken any work, at anytime, for the
Knibb brothers or their associated Companies?

D) Did the PCC attend the raid and arrest of Peter McInnes?”

In response to your request, we can advise:

A)     Information about the Evaluation Matrix used for selecting a site
for the new Merseyside Police HQ is detailed in the PCC’s decision paper
2015/46, which is publically accessible via the PCC’s website:

However, the Evaluation Matrix document itself is exempt from disclosure
under Section 43 (2) of the Freedom Information Act 2000, as this
disclosure of the requested information would, or would be likely to,
prejudice the commercial interests of any person (including the public
authority holding it).

B)     Information about the Feasibility Study used for selecting a site
for the new Merseyside Police HQ is detailed in the decision papers
2015/46 and 2015/068 which are publically accessible via the PCC’s

However, the full Feasibility Study itself is exempt from disclosure under
Scn 24(1) – Information which does not fall within section 23(1) is exempt
information if exemption from section 1(1)(b) is required for the purpose
of safeguarding national security;

Scn 38 (1)(b) – Information is exempt if its disclosure under this Act
would, or would be likely to endanger the safety of any individual; and

Scn 43 (2) – Information is exempt if its disclosure under this Act would,
or would be likely to, prejudice the commercial interests of any person
(including the public authority holding it).

We can advise that the outcome of the above-mentioned study was detailed
in decision paper 2016-55, which is publically available via the PCC’s

C)      PCC Jane Kennedy has not undertaken any work for the Knibb
brothers, nor their associated companies.

D)     There is no record of the PCC being in attendance at the raid and
arrest of Peter McInnes. Therefore, our response to this aspect of your
request is “no information held”.

I write in response to your recent email, in which you have requested an
internal review into the handling of your FOI request, specifically point
D:

“D) Did the PCC attend the raid and arrest of Peter McInnes?”

You requested a response to this question under the Freedom of Information
Act 2000. The Police and Crime Commissioner for Merseyside has a duty to
consider the release of any information which is held by her office.

The response previously provided to you in regards to point D was “no
information held” and the reasoning for this response was that there was
no record of the PCC attending the raid or arrest of Peter McInnes.

I am satisfied that the previous response to your request is correct, as
there is no information held within this office in regards to the raid or
arrest to which you refer.
