New Gas Safe contract operator, roles, duties, responsibilities KPI's and measurement

We're waiting for Robert King to read a recent response and update the status.

Dear Health and Safety Executive,

I am writing to both HSENI and HSEGB in relation to the new contract for Gas Safe Register due to commence 1/4/2019 and the requesting details on the following items under the Freedom of Information Act. I am requesting this to insure this time round Northern Ireland is not placed in a severely deficient contract by HSENI where registered companies where charged for services were not delivered by the operator with the full knowledge and support of HSENI. We would seek to see an exact mirror service in Northern Ireland in every way to insure equality and safety of the general public in Northern Ireland which the current contract totally fails to do so, to this end we request the same data from HSEGB who have been much more open in assisting in our efforts to uncover the failings in NI.
1. Proposed method of engagement with the trade something that has been totally nonexistent under the current contract both in GB and NI? Please detail fully procedure for selection of trade representation to insure as is common with government bodies only Yes people are appointed to insure difficult questions are not asked and transporters and manufacturers can run riot and rewrite the rules to suit themselves.

2. How HSEGB or HSENI plan to insure value for money, to insure funds are not siphoned off through group companies providing services to the register operator and not over charging thereby taking funds outside the remit of the accounting returns for the register operator. Will there be a need to prove that services purchased in from within a business group are value for money and not just a method of skimming profit?

3. Will there be a set percentage of turnover for public awareness? Again this expenditure should not be within the business group or with companies where there is a shareholding or control.

4. We would seek to see details of all services to be provided under the contract?
Number of inspections?
Details of trade engagements and payments to event (trade show organisers) for stands and not bully and demanding stands for attendance?
Transparency and democratic voting reflecting the makeup of the trade and that the register operator does not always act to the benefit of transporters?
Proposed method of measurement of performance in each region and the Key Performance Indicators and targets set? What will the targets be per region?
5. Method of inspecting businesses and engineers on site and the ending of SS style camp inspections where the issued documentation indicates the hotel inspections where work inspections on site which they were not? Only a work inspection allows the operator to see the engineer is properly equipped, manor and approach to work etc. One hour of lecturing and then handing out an examination paper most of the general population could pass that assessment without any knowledge of gas but was purely a cheap method to maximise profits.
Under the current scheme the mass events who drew up the examination paper?
Was the person delivering the lectures a qualified lecturer and assessor?
Which examination body approved the examination/assessment questions?
Did HSENI and HSEGB agree to the mass events and miss reporting of the assessments events?
Why were these events required? Was CGRAS behind of auditing as some registered businesses that had not been inspected in ten years?
6. The proposed method to limit influence of non trade related bodies that is boiler and equipment manufacturers, Co alarm manufacturers, builders, developers, Landlord Associations who do not directly work on gas appliances? Whilst we understand appliance manufacturers may employee hands on staff their influence to change standards needs to be clearly separated to prevent another fiasco of transfer of liability as seen in TB008.

7. Proposed action to crack down on illegal work as illegal’s have nothing to fear from current operator and in fact makes financial sense as the register operator only targets registered business? We would expect to see the performance in this sector one of the KPI’s to be measured to see something actually being done?

8. Will there be a requirement to insure that commercial information for operators of these types of premises is available on the website of the register and the current site is virtually devoid of this type of information at present?

9. Will there be a quarterly refresh of the Register website as only recently CGRAS update the website which had lay virtually untouched for two years? Should be a KPI?

10. Whilst I understand that the successful bidder has not been selected yet despite being assured earlier this year who was winning the tender we seek this information at the earliest opportunity to allow a review of what is proposed to see it is fit for purpose and whether the trade should continue to be registered or deregister and work illegally?

11. I understand that as of today no announcement has been made who the successful bidder is. I would request that not later than 20 days from announcement who the successful bidder is I would expect the full performance criteria, measure criteria and schedule of services to be delivered and a copy of the full contract?

12. I would also ask that minutes of meetings during the contract period between HSENI, HSEGB and the register operator be released within 20 days of meeting?

I am writing to request an internal review of Health and Safety Executive's handling of my FOI request 'New Gas Safe contract operator, roles, duties, responsibilities KPI's and measurement'.

Robert King is one of my given Christan names.

I believe that HSENI and HSEGB who in colbration operates a policy to attack and victimise those who highlight failings, poor value for money of public expenditure, possible fraud of allowing an appointed operator to charge for services not delivered.

This information requested is insure that the appointed operator now has to clearly set out how and where each year the money collected under the license agreement is to be spent to provide public awareness and services for the general public and registered businesses which has not occurred under the last contract. It’s strange when this is asked that both HSE bodies suddenly wish to clam up. This begs the question is there corruption inside these bodies as they are so keen to with hold this information. HSENI Mr O Neil has already suggested that this may need put to the SFO for investigation something which I will do if clear and transparent answers cannot be obtained as FOI’s are the only channel of engagement the HSE bodies wish to communicate through.

There will be claims of vexious inquiries and expense but I did not choose this as the means of communication but the lack of engagement with the registered engineering community leaves no other choice.

It appears that HSEGB appears to wish to with hold information that will prevent Registered Gas Engineers renewing their registration by failing to give clear details of what we are expected to pay for.

KPI’s of the last contract, what CGRAS is expected to deliver.

We are told of engagement with the trade? How and when as in the past we have seen the registered businesses ignored and disadvantaged and liabilities of builders, developers, boiler manfacturers dumped on service engineers due to exclusion.

We have not seen public awareness with the general public still after 10 years still looking for CORGI engineers.

No action taken to tackle the illegal gas workers?

Inspection and auditing by visiting the work place and checking the correct equipment and engineers competent with that equipment is reducing instead focusing on SS Hrade camps in Hotel with 1 hour lectures and then a paper? Who set the paper, which examination body, are the lecturers qualified? The resulting correspondence portrays these enforced events are recorded as work place inspections?

It’s clear CGRAS are off the rails and not properly supervised by HSEGB and NI.

This is the reasons for FOI’s the get at the truth and true picture of the chaos of the Gas industry where those who work in have no voice and totally ignored.

Is the registered still fit for purpose, delivering a safer industry for general public and engineers? Should the trade continue to register as the flooding of the industry with poorly trained people was the objective of CGRAS from the start to maximise profits.

Given the concert s efforts to withhold information I now ask for an internal review.

We note in your replies the SCA of what CGRAS have to deliver under the contact from the 1st April 2019 for 5 years still has not been released?

I can only take that HSEGB intend to frustrate the Freedom Of Information Request and this could be seen as “Miss conduct in public office?” A criminal offence?

I would look forward to receiving the full documentation released in the next 10 days or I will have to request internal review and prepare papers for ICO and also criminals of indivuals. I would that Civil Servant can held liable for actions.

I am writing to request an external review of Health and Safety Executive's handling of my FOI request 'New Gas Safe contract operator, roles, duties, responsibilities KPI's and measurement'.

All during this Freedom of Information Request HSEGB has entered into conclusion with HSENI to frustrate the disclosure for the information.

They have thrown out the support ajudication of the tender which CGRAS Ltd won who boasted they had it in the bag in April in a meeting to threaten and bully us from asking questions even before their tender was submitted.

HSEGB have failed to detail what roles they are to deliver as asked for in my original request myself now being asked to pay fees for which I have no idea what service will be delivered?
In NI we have been subjected to fraud which is now supported with a court judgement where NI engineers where charged the same fees, all the literature, CGRAS publication etc told us we where receiving public awareness, and getting a mirror image of the GB contract. In reality HSENI and CGRAS had entered into a secret deal where HSENI kept secret they had omitted roles from the contract to CGRAS Ltd but never informed the trade resulting in NI engineers paying for services not provided to the trade or public resulting in deaths due to lack of public awareness.

An example is "staygassafe" website, hosted on the same server as gas safe register but no NI post code works in it. No Building control notification but uses same IT and office resources which NI pay a share of but not available to us. No billboards, no media, excluded from cutting corners campaign. The one effort by Mr Darroch of GSR on a telephone interview repeatedly gave the wrong gas emergency number for NI.

Personal information was communicated back and forth regarding this request to frustrate and try and protect the actions of some.
We have already contacted MP's to request the contract pulled under the Public Procurement Act 2015 where a legal entity cannot hold a public contract if they have a fraud judgement.
We have also asked that MP's look into the whole tendering of this public contract as looking from the outside it look and smells like Billingsgate fish market.
We have no idea what CGRAS is going to do, promises of trade engagement, nothing heard in six months, action on illegal gas workers, no communication its going to be the same shambles, bully boy tactics and possible manipulation of KPI's to make it look like all is well and civil servants being lead round like prize bull with a ring through their nose.
I will be writing to ICO requesting an investigation and will preparing documentation for the SFO to investigate this tendering of this contract.

No doubt this will be obstructed, delayed, ignored, excuses made to delay further and more useless answers put out to try and drive me and others away.

I am not willing to renew my registration as I am being asked to pay for something which I have no idea what I will be getting for my fee. The whole scheme is a total failure and when council representatives say"CORGI meant some sort of standard, whats gone wrong?" us in the industry know profit before safety.
