I write with reference to your FOI request. Firstly, please accept our apologies for the delay in coming back to you. I would be grateful if you could clarify the following for us please.

Bridgend County Borough uses a waste contractor for all its collections. Can you confirm if the questions relating to the contract are referring to the contract the Council has with that contractor or are they referring to a contract that our contractor has with a company who take the paper and card from them?

If I do not hear from you within 1 month, the Council will assume you no longer require a response to your request.

We refer to your email dated 20 December 2022 which contained a request
for information as set out in italics below.  Firstly, please accept our
apologies for the delay in responding to you.  Following consideration of
your request, in accordance with the Freedom of Information Act 2000, I
respond to each point as follows:

What are the contractual performance KPI's for this contract?

Achieve 80% recycling rate at CRCs

Make waste collections to all Bridgend Households in line with the
authority’s statutory duties

• Suppliers who applied for inclusion on each framework/contract and were
successful & not successful at the PQQ & ITT stages

The Council consider this information to be exempt under section 43(2) of
the Freedom of Information Act 2000 which states:

43(2)

Information is exempt information if its disclosure under the Act would,
or would be likely to, prejudice the commercial interests of any person
(including the public authority holding it)

Section 43 is a qualified exemption. This means that for the exemption to
be properly applied it must be shown that the public interest in
withholding this information outweighs the public interest in disclosure.

In considering the public interest we have identified the following
factors:

Factors favouring disclosure:

·                Disclosure would facilitate accountability and
transparency in the Authority’s delivery of its services.

Factors against disclosure:

·                The potential to damage the current provider’s commercial
interests in a competitive environment by revealing market-sensitive
information or information of potential usefulness to the provider’s
competitors.

·                There is a tender process open on this service at this
current time. 

In conclusion and in balancing these factors, I am satisfied that the
public interest in withholding this information outweighs that in its
release.

In accordance with Section 17 of the Freedom of Information Act 2000 this
letter acts as a Refusal Notice as we have not provided all of the
information requested.

A copy of this document is currently awaited from the Council’s Waste
Management section and a response will be provided in due course.

• Is there an extension clause in the framework(s)/contract(s) and, if so,
the duration of the extension?

Yes, +7yrs

• Has a decision been made yet on whether the framework(s)/contract(s) are
being either extended or renewed?

Yes

• Who is the senior officer (outside of procurement) responsible for this
contract?

Whilst we can confirm that we hold the information requested for the
responsible senior officer, we consider that this information is exempt
under section 40(2) of the Freedom of Information Act 2000 which states:

(2) Any information to which a request for information relates is also
exempt information if—

(a)it constitutes personal data which does not fall within subsection (1),
and

(b) the first, second or third condition below is satisfied.

(3A)The first condition is that the disclosure of the information to a
member of the public otherwise than under this Act—

(a)would contravene any of the data protection principles,

Disclosure of the names of individual staff members would breach the first
data protection principle as set out in Article 5 of the General Data
Protection Regulation which states:

 1. Personal data shall be

 a.       Processed lawfully, fairly and in a transparent manner in
relation to the data subject (‘lawfulness, fairness and
transparency^2);

Article 4 of the General Data Protection Regulation states that:-

For the purposes of this Regulation: (1) ‘personal data’ means any
information relating to an identified or identifiable natural person
(‘data subject’); an identifiable natural person is one who can be
identified, directly or indirectly, in particular by reference to an
identifier such as a name, an identification number, location data, an
online identifier or to one or more factors specific to the physical,
physiological, genetic, mental, economic, cultural or social identity of
that natural person;

The Information Commissioner’s guidance “Access to Information about
public authorities’ employees” and “When should names be disclosed”
provide guidance on how the Authority should treat requests for
information of this nature. The Authority considers the information
requested to be absolutely exempt from disclosure by virtue of Section
40(2) of the Freedom of Information Act 2000.

The Authority does not consider that it would be fair in all the
circumstances to identify the individual as whilst the information relates
to them in their professional capacity, they would not reasonably expect
their details to be placed into the public domain. The Authority’s
procedure is not to disclose as a matter of routine information about
members of staff below Corporate Director level.

Under Section 40 of the Freedom of Information Act, the information
requested is subject to an absolute exemption. This exemption applies
because the information requested would constitute a disclosure of
personal data.

Therefore, to the extent set out above, this letter acts as a Refusal
Notice in accordance with Section 17 of the Freedom of Information Act
2000 as we have not provided the information requested.

We can however advise you that the Corporate Director – Communities has
