Dear Ministry of Defence,

Please provide the following:

1. Who erected the new fencing between the southern border of the Brunswick Training Camp and the Basingstoke Canal ?
2. Under which Bylaws were the fences erected ?
3. What was the cost of erection of the fences ?
4. What maps were used to identify the boundaries of the Brunswick Training Camp - please provide maps used.

With regard to answer no 2 the current bylaws do not bestow on the DIO any rights to erect fences so can you please confirm under what authority the fences were erected.

Dear Mr Slack,

Thank you for your email of 16 May 2020 in response to your Freedom of Information request (FOI04570), asking the below question:

“With regard to answer no 2 the current bylaws do not bestow on the DIO any rights to erect fences so can you please confirm under what authority the fences were erected.”

I can confirm that as the MOD is the owner/occupier of the said Training Estate, the MOD is therefore permitted to do all that is necessary to properly manage the land.

The Military Lands Act 1892 (MLA 1892) requires the Secretary of State to mark the boundary of the area that byelaws apply to, which it does using fences or boundary markers.

I hope this explains the Departments position.
