Can you please also provide me with details of the Council Cabinet/Committee/Sub-Committee meetings where the vacancy was discussed? Dates, times, agendas, attendees, minutes please. Where would vacancies at Director level normally be discussed/recruitment agreed?

Please provide details of how this role fits into the Council's Senior Management structure? Why are there now two Directors for the Places Department (Tom Mccourt and Anne Sutcliffe) and how is this Value for Money for Ratepayers?

The Council responded as follows:

The Council recently advertised a number of senior roles including the
Corporate Director, Place. Jobs were advertised online at the Council’s
website, in the Municipal Journal, on the website of Penna, and on a
dedicated Tower Hamlets site designed specifically for the senior roles..

The Council did not appoint to the Director of Place having undertaken
interviews with six candidates.

The Council ordinarily makes appointments to Director level jobs using a
Councillor Appointment Sub Committee. The papers to the Committee are
exempt by virtue of Schedule 12A of the Local Government Act 1972. I can
confirm that the Committee met on 29 March 2017.

The Council management structure is attached and provides for one
Corporate Director of Place. That post is covered on a temporary basis by
Ann Sutcliffe, a current member of staff. Tom McCourt is engaged to add
capacity to a number of projects on a consulting basis. He will also take
line management responsibility for the Public Realm division.

On 15 August you requested an Internal Review of this response on the
grounds that the reply did not answer your questions.

I have reviewed the response and apologise that all of your questions were
not fully answered.

On 25 January 2017 the General Purposes Committee set up a sub-committee
for this recruitment and on 21 March 2017 the Appointment Sub Committee
received the recruitment consultants’ recommendation to interview 6
candidates.

You asked who was on the interview panel, and I can confirm that on 29
March 2017 this appointment was considered by the Appointments Sub
Committee, the members for which were; Mayor John Biggs, Cllr Rachel
Blake, Cllr Peter Golds, Cllr Sirajul Islam and Cllr Rabina Khan.

The papers for the 3 meetings at which the recruitment was discussed were
all issued as exempt from disclosure, as previously mentioned in respect
of the meeting on 29 March 2017.

An additional post has not been created. The individual undertaking the
activity is not a council employee. It was determined after the
Appointment Sub Committee that the Council needed additional capacity
within the Place Directorate for a 12 month period to provide specialist
support in delivering success in our waste and recycling contract service,
ensuring our planning service is fit for the future and the management of
the housing contract with Tower Hamlets Homes.

The costs of these time-limited arrangements are being met from the
directorate salaries budget and the Council's transformation reserve and
the arrangement provides the significant focus required now to get the
maximum benefit over the longer-term.

Dear London Borough of Tower Hamlets,

My questions still haven't been answered. My questions were in realtion to the appointment of the Strategic Director of Places, not the Corporate Director of Places. The meetings you referenced in your response relate to the latter post, not the post that my questions related to.

I would also point out that Schedule 12A of the Local Government Act 1972 is not a valid reason for refusing an FOIA request.

Please confirm that this is the Council's final response to my request for a review so I can take a view on whether i escalate this to the Information Commissioners office.

It's good that you understand the law. I think the council have given me a lot of invalid refusal notices.

They have not given the name of an officer conducting an internal review like they are meant to despite me asking them for it. They now have got worse after Lutfur Rahman and the DCLG Commissioners left. Staff do anything they like.

Thank you for your email of 18 September 2017. For clarity, the
recruitment to the temporary post of Strategic Director of Place arose out
of the recruitment process described for the Corporate Director of Place
and a candidate was appointed to the fixed term post.
 
In respect of committee papers, papers falling under Schedule 12A of the
Local Government Act 1972 are exempt from disclosure under section
44(1)(a) of the FOI Act 2000 as disclosure by the public authority holding
it (otherwise than under this Act) is prohibited.
