Dear North Lanarkshire Council,
I am looking for information on Anti Social Behaviour with the council response along with any police reports and responses along with information on the shared garage structures at Nevis Place and Elgol Path, Shotts.
Can the numbers associated with any of the following be included along with the responses to each of the associated?
1) Number of anti-social complaints for the following:
i) Nevis Place
ii) Elgol Path
b) Number of police responses reported to the council for:
i) Nevis Place
ii) Elgol Path
2) Information on the garages at Nevis Place
a) Date of last building inspection
b) Current number of garages in use
c) Internal garage specifications
d) Number of concerns raised around anti-social behaviour associated with these garages and any council or police response.

Request for Information
I refer to your email dated 9 December 2024 seeking information in
relation to the shared garage structures at Nevis Place and Elgol Path,
Shotts and your email dated 16 December 2024 providing clarification of
your request.
Having investigated, my response to your questions is as follows:-
For the first part of your request, I regret to advise that I am unable to
provide Council responses to complaints as this is the personal data of
the individuals who have made complaints. Accordingly, I must advise that
the release of this information would contravene the data protection
principles and that this constitutes a ground of exemption in terms of
Section 38(1)(b) of the Freedom of Information (Scotland) Act 2002.
With regard to Police Reports, I can advise that these are not held by the
Council and in terms of Section 17 of the Freedom of Information
(Scotland) Act 2002, I must advise you of this. Police Scotland may be
able to assist and should you wish to submit a FOI request to them. Their

Please find below responses to the remaining parts of your request:-
Q1 – Number of anti-social complaints in the last 5 years.
i. Nevis place – 46 complaints
ii. Elgol Path – 1 complaint
Qb - Number of complaints received via Police Scotland in the last 5
years.
i. Nevis Place – 3.
ii. Elgol Path – 0.
2a) Locality staff visited 22/11/24 and reported lock ups in good
condition. No remedial inspections or works issued in the last 12 months.
Lock ups do not appear to have been painted for some time.
b) 3
c) No internal fittings or fixtures. Metal up and over doors.
d) No concerns received by Housing Office. One enquiry received in Nov
2024 enquiring if garages could be demolished and replaced with a car park
due to children using lock up site.
I can advise that North Lanarkshire Council, having regard to the
provisions of Section 21 of the Freedom of Information (Scotland) Act
2002, has established a procedure whereby any person who has requested
information and is in any way dissatisfied with the decision on that
request, can within forty working days require a review of that decision
by writing to the Chief Officer (Legal and Democratic), Civic Centre,
Windmillhill Street, Motherwell ML1 1AB. Accordingly, if you are
dissatisfied with this decision and seek such review please write to the
Chief Officer (Legal and Democratic).
I would advise, also, that in terms of Section 47 of the Act a person who
is dissatisfied with a notice given by the local authority under Section
21 of the Act - ie. a notice following a review of a decision by a local
authority, or by the failure of a local authority to give such a notice -
may make application to the Scottish Information Commissioner for a
decision as to whether, in any respect specified in that application, the
request for information to which the requirement relates has been dealt
with in accordance with the Act. Such an application must be made within
six months of the review decision and be in writing or in another form
which, by reason of it having some permanency is capable of being used for
subsequent reference. The application must state the name of the applicant
and provide an address for correspondence. The application must also
specify the request for information to which the requirement for review
relates, the matter which gave rise to the applicant’s dissatisfaction
with the original decision of the local authority and the matter which
gives rise to the applicant’s dissatisfaction with the decision on review
by the local authority or the failure of the local authority to issue such
