Dear FOIA (HEALTH EDUCATION ENGLAND),
I note that your response is now delayed and that no explanation has been provided as to the cause of the delay or the likely date of your response. I would appreciate a prompt response with the data requested or an explanation of the delay and a confirmed delivery date, please.

Dear Mr Yates,
RE: Freedom of Information Request
I refer to your email of 28 July 2016 in respect of attaining information
relating to training places and recruitment into neurology.
I can confirm in accordance with S.1 (1) of the Freedom of Information Act
2000 (FOIA) that we do hold the information that you have requested. I
would like to take this opportunity to apologise to you for the slight
delay in response. HEE takes the burden placed on it in terms of its
obligations relating to the FOIA very seriously. However, the delay
occurred following the unexpected absence of a member of staff involved in
the collation of the requested figures. Nevertheless, in an attempt to
provide you with as much information as possible, we have attached the
data we have available to us at this time. It is anticipated that we will
be able to provide you with the remaining data (April 2015) by the end of
this week and we will contact you tomorrow to confirm that.
Please note that the information we have collated is part of a 6 monthly
stocktake in which the figures are only accurate at that point in time.
There is always likely to be some variation in figures but these are
anticipated and calculated into the recruitment figures; the flux in post
data may not reflect actual reductions or increases in post numbers
therefore no assumptions should be made.
You should also note that the information provided only includes neurology
training information and does not include and neurology posts that may
occur in other training programmes for example, General Practice. The
figures provided are not NTNs as HEE does not commission these, they are
the number of filled training places funded by HEE.
I hope that this information is of use. If you are dissatisfied with the
way in which we have dealt with your request you can ask us to review our
decision by writing to:-
Mr Lee Whitehead
Director of People and Communications
Health Education England

If at the conclusion of any review you remain dissatisfied you may
complain to the Information Commissioner who can be contacted at:-

Dear FOIA (HEALTH EDUCATION ENGLAND),
Thank you.
You have only made a partial response and have not addressed why a complete response has not been made.
For questions (i), (iii) and (iv), you have provided aggregated data for the whole of England, and have not presented the data by LETB, as was clearly requested.
I would be grateful for a response that relates entirely to my original request, please.
Yours sincerely,
Tim Yates
Dear Mr Yates,
Thank you for your email, you will now find attached all of the
information broken down by HEE's 4 Local Education and Training Boards
(LETBs). Should you submit a further request for the information to be
broken down further, I have been advised that this may not be released to
you on the grounds that it could make individuals identifiable.
Section 40 (2) of the FOIA applies to third party personal data and is
exempt from disclosure under the FOIA if disclosure would breach any of
the data protection principles contained within Part 1 of Schedule One
under Section 4 (1) and (2) of the Data Protection Act 1998 (DPA).
One of the main differences between the FOIA and the DPA is that any
information released under the FOIA is released into the public domain,
not just the individual requesting the information and disclosure under
the FOIA must be made with that in mind. As such, any release that
identifies an individual through releasing their personal data, even third
party personal data, is exempt.
All persons whose personal data is processed by HEE, regardless of whether
they be staff, trainees or members of the public, have an intrinsic right
to privacy and these rights are protected by virtue of the DPA. Release of
the information subject to the exemption is likely to compromise those
rights.
