1. If a PERSON under your authority, or a CORPORATION, seeking to be governed by yourselves (FCA), dismissed an employee on the 02/02/2016, but the PERSON was not enrolled onto the NEST Pension Scheme until 09/02/2016, should any form of payment be taken from the employee by the employer/NEST before or after his/her enrollment onto NEST?

2. If the answer to question 1. Is yes. What dates would/should a payment, at the earliest/Latest be taken from the employee, by the employer/NEST?

3. If the answer to Q1 Is no, would this be fraud?

Thank you for your request under the Freedom of Information Act 2000 (the
Act), for the following information,

 

    “1. If a PERSON under your authority, or a CORPORATION, seeking to

     be governed by yourselves (FCA), dismissed an employee on the

Section 8(1) of the Act sets out the requirements of a ‘valid request for
information’ and explains that a request must, amongst other things,
“state the name of the applicant”, i.e. the applicant’s real name. 
Therefore a request made by an applicant using a pseudonym is not valid
and we are not obliged to deal with the request.

 

Can you therefore please provide your name so that we can consider your
request in accordance with the Act.

Thank you for your email of 2 March. A “request for information” under the Freedom of Information Act 2000 (FOIA).

You ask if we are 100% certain that you are not using your real name. We are not.

However, for your request to be a valid “request for information” under section 8(1) of FOIA you have to provide us with your name. As paragraph 21 of the ICO’s guidance in the link I sent you sets out:

“For a request to be valid, the requester must provide enough of their real name to give anyone reading that request a reasonable indication of their identity.”

We do not consider this is the case in this instance. Your email address is: “John - X [FOI #318966 email]”. While you sign yourself as “King John, Of his Own Temple”.

In an attempt to be helpful I also attach a link to a recent decision of the First Tier Tribunal which, among other things, deals with what constitutes a valid request under section 8 of FOIA. http://www.informationtribunal.gov.uk/DB...

In addition in looking again at your email of 28 February, we do not consider that it constitutes a “request for information” held by this Authority. It appears to be a request for legal advice relating to a particular factual scenario, involving an apparent dispute between an employee and an employer/pension scheme. We are unable to provide you with such advice I’m afraid. We can only suggest therefore that you seek independent legal advice on the question you put to us.

I did NOT ask If you where certain that I was not using my real name, I asked you to prove It. Please prove that this Is not my real name. If you fail to prove this, please answer my questions In full. Also...

If you could address question 1. Why could you not address my other questions?

SURNAMES are Crown/Vatican owned, so I don't own a surname, I comprehend you want my ID - Entity (LEGAL NAME) but this would be fraudulent, as stated on the birth certificate. Please address my previous questions, and the following.

Are you asking me to commit fraud? By way of asking for a fictitious Name?
Are you trying to cover up fraud? As this Is a simple request, and you seem desperately unwilling to answer.

My name Is john, my body Is my Temple, to which I am King. So please do not refer to me as "Anon".

However, as we attempted to explain, according to the guidance produced by
the [1]Information Commissioner’s Office, we do not have to prove that you
are not using your real name. If you consider that the guidance we
referred you to is legally inaccurate, we can only suggest you take the
matter up with that Office.

As we also attempted to explain, we do not consider the questions you have
asked amount to a valid request under the Freedom of Information Act 2000.
Nor can we offer you legal advice.  

We have not asked you for a fictitious name. We do not consider that the
action we have taken amounts to an attempt by us to commit or cover up
fraud.
