NESBReC - Escort Agency - Aberdeenshire Council

We're waiting for Iain Lawrie to read a recent response and update the status.

Dear Scottish Natural Heritage,

Hi

I'd like to follow up previous requests relating to funding for NESBReC - that's the outfit run by Aberdeenshire Council that you 'mistakenly' put in the organisation name when it comes to funding applications. I'm just curious if you're still funding them - if so, can you provide the funding details, application, and anything else related to the application for the past 5 years.

This is the lot that covered up the use of at least 4 separate escort agency websites and as far as I'm aware they still do. Thing is, because they cover it up they can't be trusted to tell you the truth - because guess what, they'll cover it up.

Not sure I fully understand the irrecoverable VAT and why there are costs there particularly as I note that there's no VAT number disclosed which appears to be highly irregular even for the likes of Aberdeenshire Council. Could you possibly explain in more detail what that's all about? Of course, if that's not part of an FoI request, then please just treat it as a complaint.

As a separate request could you also look at all communications between SNH and NESBReC/Aberdeenshire Council (or whatever you call them) relating to VAT

"As a recurring recipient of funding, we do not require confirmation of the VAT Registration
number. Our standard terms and conditions of grant require a recipient of funding to inform
us of any change in VAT status."

What is the current status of NESBReC in relation to VAT given that you imply you have base data for comparison to determine if there has been a change - has NESBReC declared on any grant application that they are VAT registered due to being part of the council?

How do you define a recurring recipient - surely they must have to apply like everyone else and so each application would be unknown as to the outcome - in other words how do you know beforehand that the grant is successful, which would have to be the case to show true recurrence.

You have responded with a rather confusing answer - perhaps you can supply me with the appropriate information that you refer to in your response in order to be more helpful

Your response states

Our financial records confirm that NESBREC is VAT registered. We have not found
any further grant application in which NESBREC has declared their VAT status. We
note earlier correspondence (18 September 2015) which stated:

“The VAT number we currently use for NESBReC is the same as the VAT number we
used for the previous grants, and was provided by Aberdeenshire Council. The VAT
number has not changed over the past 5 years.”
We confirm that the VAT number remains the same

It would certainly be helpful if you can supply the document that Aberdeenshire Council provided you with? And also any other documentation that clearly shows Aberdeenshire Council have disclosed their VAT number in relation to NESBReC - at the minute I see nothing to suggest that they have, simply because despite my repeated requests you've not actually shown any documentation to confirm this.

Also you refer to financial records that confirm this - can you give me a copy of the financial records that you refer to please, showing and explaining clearly how these records present the confirmation that you speak of. It would also be helpful if this confirmation shows that this has been from the very first grant application for NESBReC, back in around 2000 - to help clear this up it would also be useful if you could supply me with a copy of the initial grant application made by Aberdeenshire Council for funding the NESBReC project.

In regard to your reply on 8th March and located in a previous reply (shown above) you clearly state that Aberdeenshire Council provided the VAT number as part of their grant submission - I would like to see that grant submission. I'm not sure how many times I need to ask you the same thing? If you no longer have the form then how do you know it hasn't changed? For whatever reason, you appear to be very obstructive of what is a simple request - if Aberdeenshire Council have supplied the VAT number as part of the grant application process then I would like to clearly see that they have done so and that it is clearly associated with the grant submission. I assume you would need such information for your own records. Please treat this as an internal review so we can progress this outwith SNH.

With regard to Question 33 on the 2009 application which you have kindly supplied, and where NESBReC have responded that VAT can be reclaimed, you should also at that time have been aware of Applications for Payment of Grant which state that VAT cannot be reclaimed.

When asked the question Can VAT be reclaimed? the response given is clearly shown as No.

Dear FOI,

You clearly stated there was a review prior to my 2 recent FoI requests but I see no evidence here that demonstrates any review actually took place. For the 3rd time I will ask you for the documentation relating to that review. I will also send a copy of this to my local MSP to demonstrate your failings in the handling of my FoI requests. Please if you find it difficult to understand what I'm asking, then by all means seek clarification as is expected as part of this process. Just to make it clear, I have now effectively been waiting over 50 working days to answer a request which could easily have been answered in 1, simply by supplying the already existing documentation of your own review into the handling of the incorrect VAT status as supplied to yourselves by Aberdeenshire Council.
