NDAs Negotiated Outside Acas COT3 Arrangements

We're waiting for Melanie Pike to read recent responses and update the status.

Dear Manchester Metropolitan University,

I wish to know how many non-disclosure agreements (NDAs) were signed by current/former staff at Manchester Metropolitan University over and above Acas negotiated COT3 arrangements in the following years:
- 2016
- 2017
- 2018
- 2019 (to date)

So, to clarify, that is staff who have left the university via tribunals/grievance process and have signed NDAs as part of settlement arrangements that were NOT negotiated by Acas.

Yours faithfully,

Melanie Pike

Dear Ms Pike

We have received your request for information below.  Please note that, as
this request is very similar & related to your previous request (FOI
2019/297) which we have just answered, we are entitled to aggregate these
two requests. This means, for example, that if the time taken to comply
with these requests when aggregated would exceed the cost limit for
compliance under the Act, we are not obliged to provide the requested
information.

However, we will look into the matter and provide you with our response
within 20 working days.

Kind regards

Dear FOI,

As per your email the two requests may seem similar but both are looking at entirely different information sources:

1. Acas negotiated NDAs
2. Non-Acas negotiated NDAs

There is also the issue, as flagged in my last email, that there would seem to be a level of missing data in the previous FOI supplied regarding Acas negotiated NDAs. I have been made aware of at least one NDA from 2017 by a former employee and the figures do not seem to tally with the average of universities. I believe data had been held back within that FOI.

Yours sincerely,

Melanie Pike

Dear requester

We believe that you are using a pseudonym rather than your real name.  If
so, your requests FOI 19/297 and FOI 20/014 are not valid and the
University is not obliged to respond any further.

Of course, if we are incorrect and you can provide us with evidence of
your name and identity, we will then reconsider your requests.

If you are dissatisfied with this response and wish to appeal our
decision, please write to [1][Manchester Metropolitan University request email] giving your reasons for
appealing.  You must appeal within 40 working days of the date of this
email.  Under s5.3 of the Freedom of Information Act Code of Practice, we
are not obliged to accept appeals/internal reviews after this date.  You
also have a subsequent right of appeal to the Information Commissioner’s

Dear Manchester Metropolitan University

How very dare you imply that I might somehow being working to a psuedonym.

I am most insulted by such insinuation.
