to the University for each intake

The number of students that graduated based on the number
of students that started for each intake

Thank you for your information request dated 13 March 2014.

 

The University does not record this information for enrolling or enrolled
students as standard procedure as there is no requirement for us to do so.

 

Please accept this as notice under s.17 of the Freedom of Information
(Scotland) Act 2002 that we do not hold the information sought for
questions 4 to 8.

 

With regards the information requested for questions 1 to 3, the
University has been previously provided with some information to which
your questions relate, however, as this information was provided in
confidence we consider it to be exempt from disclosure under the Act for
this reason and, additionally, as its release would, or would be likely to
prejudice substantially the commercial interests of both parties involved.
This therefore acts as a refusal notice under s.16 of the FOI(S)A 2002, as
we consider this information to be exempt from disclosure under s.36(2)
and s.33(1)(b) of the Act.

 

s.36(2) – Confidentiality. Information is exempt information if –

            (a) it was obtained by a Scottish public authority from
another person; and

            (b) its disclosure by the authority so obtaining it to the
public (otherwise than under this Act) would constitute a breach of
confidence actionable by that person or any other person.

s.33(1)(b) – Commercial interests. Information is exempt information if
its disclosure under this Act would, or would be likely to, prejudice
substantially the commercial interests of any person (including, without
prejudice to that generality, a Scottish public authority).

When applying the public interest test we have considered whether the
public interest in disclosing the information to demonstrate openness and
accountability, is outweighed by the public interest in maintaining the
exemptions to ensure that both parties are able to effectively compete in
a very competitive market and that the University is able to maintain its
business relationships with partner organisations. We consider that the
public interest in maintaining the exemption outweighs the public interest
in disclosing the information, as there are other mechanisms which ensure
accountability and there are no mitigating factors to justify the
potentially adverse effect on the ability of both parties to compete in
the market and the resultant potential harm to their commercial
activities.

refer you to NAVITAS and ask that you contact them with your request.

 

Follow-up procedural guidance

 

If you are not happy with the way the University has dealt with your
request for information, you have a right under FOISA to request a review
of this decision. If you wish to exercise this right, you must write to
the University to request a review within forty working days of receipt of
this decision. Your request for a review must be in writing and you must
specify your name and address for correspondence.  You must also identify
the decision that you wish to have reviewed.
