(Email sent on behalf of Paul Clark, College Secretary)
Dear Ms Soeder
Request for Information
Ref No: 47/17-18
Thank you for your email received on 20 01 18 requesting information from
City of Glasgow College. The response from this College is as follows:
Please advise the total cost split between capital and maintenance?
The information is contained in the original disclosure response to which
you refer.
Please advise if you have extended the initial 2 year maintenance contract
with the same provider given that there was an option to extend for 3-5
years?
Yes, we have extended this contract.
Or
Have you put this maintenance contract out to public tender?
Please supply a copy of the original maintenance support agreement?
The response to this request remains as stated in the original disclosure
response and restated below:
We are not disclosing this information on the basis of section 33 of the
Freedom of Information (Scotland) Act 2002 for the following reasons:
The information relates to the detail, scope and methods of the
contractor's service offering and the service levels they commit to
provide. This unique methodology is at the core of the value of their
business and if the contract, or any part of it, was released into the
public domain it could very easily have a detrimental effect on their
business, including the possibility of providing an unfair advantage to
competitors by allowing them to see the confidential terms on which they
do business with the College.
From the College’s point of view, this could also prejudice our commercial
interests, in that other suppliers could use such terms as a benchmark
when discussing future deals and seek to limit the College’s negotiating
position and its scope to agree different or more favourable terms.

Furthermore we do not consider that it is in the public interest to
disclose this information given the possibility of prejudicing fair
competition and value for money in relation to public procurement.
If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review. Internal review requests should be
submitted within 40 working days of the date of receipt of the response to
your original letter and should be addressed to: Paul Clark, College
Secretary.
Please remember to quote the reference number above in any future
communications.
If you are not content with the outcome of the internal review, you have
the right to apply directly to the Scottish Information Commissioner for a
decision ([1]www.itspublicknowledge.info/Appeal).
Yours sincerely

Dear City of Glasgow College,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of City of Glasgow College's handling of my FOI request .

I do not believe that you have applied exemption 33 appropriately to this request. I am bewildered as to why you are unable to provide information on the manner in which public funds are spent.
