National Insurance Credits can be sanctioned (or not)?

Don Pedro (Account suspended) made this Freedom of Information request to Department for Work and Pensions

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

The request was partially successful.

Don Pedro (Account suspended)

Dear Department for Work and Pensions,

Grimsby jobcentre has sanctioned my National Insurance credits.

However,

A judgment from a Social Entitlement Tribunal says it is unlawful for National Insurance credits to be sanctioned:

http://www.scribd.com/doc/193302234/Soci...

Has Grimsby jobcentre acted lawfully in sanctioning my National Insurance credits which consequently creates gaps in my pension entitlement?

If this is not considered a request for recorded information, will you please provide the relevant law which I consider will be recorded information if it exists.

Yours faithfully,

Don Pedro

Dear DWP Strategy Freedom of Information,

Thank you for your response (27 March 2014) in which you stated:

"In cases where the contribution conditions are not satisfied and a claimant is registered for credits only, a sanction cannot be applied. The relevant legislation is Regulation 8A of the Social Security (Credits) Regulations 1975
http://www.dwp.gov.uk/docs/a3-2351.pdf
If you have any queries about this letter please contact me quoting the reference number above."

Could you please state which specific reference in Regulation 8A provides that a claimant registered for credits only cannot be sanctioned?

Yours sincerely,

Don Pedro
