Please note that the Council is experiencing problems with the computer
system we use for such requests.  Unfortunately, you may receive another

Once again, you have broken the law.

By law, you were supposed to have responded no later than August 7, 2014, and you have failed to do so.

It is clear that Croydon Council regards its duties under the Freedom of Information Act with utter contempt.

I am writing to request an internal review of Croydon Borough Council's handling of my FOI request 'Nathan Elvery and Sundragon Associates Ltd'.

The request was made in July, and specifically requested copies of internal correspondence between the then council CEO, Nathan Elvery, the Borough Solicitor and others during a specified period regarding Elvery's directorship of a private company, Sundragon Associates.

The information provided - after the statutory time limit - was made up entirely of correspondence between Elvery and myself. I have never held office in Croydon Council.

I would suggest that this is deliberate procrastination and avoidance of the local authority's legal duties regarding Freedom of Information.

Freedom of Information Act 2000 Request

 

 

Thank you for your email dated 4 November 2014 requesting a review of how
the Council handled your request for information which was:

 

 

“…Please provide copies of all correspondence between the then council

and Nathan Elvery between 2009 and 2013, regarding the role of Elvery, the
council's finance director and deputy CEO, and his involvement with a

The Council’s original response dated 12 August 2014  confirmed that it
had disclosed all the information it retained in relation to your request.

 

 

You wrote in your email of the 4 November 2014 that the information
provided after the statutory time limit was made up entirely of
correspondence between  Mr Elvery and yourself. You suggested that this
was deliberate procrastination and avoidance of the local authority's
legal duties regarding Freedom of Information. You repeated your request
for all the information as originally requested.

 

 

I have considered your request for the information and have made
additional inquiries and have attached two additional email threads dated
the 19 and 20 February 2013 relating to your request. I confirm that the
attached information in addition to the information accompanying the
Council’s response dated the 12 August 2014  is all the information that
the Council hold in respect of this matter.

 

 

Furthermore I accept that there has been a delay with the original
response to your request and apologise for it.

 

 

You have the right to apply to the Information Commissioner for a decision
as to whether the Council has dealt with your request in accordance with
the requirements of Part 1 of the Act.  I can confirm that my response
concludes Stage 3 of the council’s complaints procedure (which is
available on the public website).
