Dear Ceredigion County Council,

i a man an individual are exercising my right under the Freedom of Information Act 2000 for information held by Ceredigion County Council .

The information i a man an individual require:-

1. What is the name of the Section 151 Officer, or the Finance Manager within the council? No other personal details of the post holder is required.

2. Is the Section 151 Officer or the Finance Manager responsible for the income of the council? If so, what income and what is the capital? This exclude Rent Receipts (Domestic and Non-Domestic), Council Tax Receipts (Domestic and Non-Domestic), Parking Charge Notices, Planning Applications, Commercial services that the council provides, Room rentals and Hall rentals.

3. Is the Section 151 officer or the Finance Manager responsible for the outgoings of the council? Please list details, particularly Court Proceedings, by the Housing Department in the last 10 months, relating to evictions and a full breakdown of an eviction, such as court costs, locksmiths, vehicle hire and any other miscellaneous costs and please give their full name/s and the costs to each man and woman.

4. What is the actual number of evictions, which have taken place, within the past 10 months? Please list how many evictions took place per month. Personal details of former tenants are required, and the correct and the actual and factual number of evictions that took place in each month of the 10 months. must be fact's and cannot withhold any information.

5. What is the actual number of the evictions please don't withhold any information/s, for rent arrears, in the last 10 months? personal details of former tenants are require, insist and demand the actual and factual number of evictions that took place.

6. What is the factual and actual number of evictions that took place, in the last 10 months, which were for rent arrears and had Bedroom Tax exacerbate the rent arrears? personal details of former tenants are required, just the actual and fact's to the number of evictions that took place.

7. What is the actual and factual number of evictions that took place, within the last 10 months, relating to anti-social behavior?

8. What is the Council’s definition of anti-social behaviour? Is this as per a statutory definition or a definition taken from The Oxford Dictionary? If it is as per a statutory definition, please name the statute or statutes it is drawn from. If it is taken from The Oxford Dictionary, for the avoidance of doubt, please quote the definition as written in The Oxford Dictionary.

9. What is the name of the Council’s Anti-Social Behaviour Team Manager? other personal details are required, only their full name is required.

10. In relation, to all evictions carried out, which company of locksmiths is/are contracted to the Council? Is/Are the company and its/their employees, carrying out any work for the Council, a member or members of the Master Locksmiths Association?

11. Are Council employees or officers subject to any form of incentive or bonus, financial or otherwise, for a completed eviction? If so, what is the incentive or bonus per eviction and what department receives it? Does the incentive or bonus go back into public funds and, if so, into which fund?

12. Is the Council in receipt of any form of incentives or bonuses, financial or otherwise, to make housing available? If so, how much per home is made available and from which source(s) do such incentives or bonuses originate? Do any incentives or bonuses go into public funds and, if so, into which fund(s)?

13. Which Council Officers attend court hearings on behalf of the Council in the case of evictions? Full name and positions held. Are these Council Officers Legally and lawfully trained/qualified and are their names on a Legal register, namely, Bar Standards Board (BSB), Chartered Institute of Legal Executives (CILEX), Solicitors Regulation Authority (SRA), Ministry of Justice (MoJ) or other legal regulatory body?

14. Under what legislation does the Council seek possession of property in the case of evictions? The actual statutory provision(s), not reason(s) for eviction, is/are required.

15. Do any of the Council's Housing Officers/Managers hold qualifications in the fields listed below? (This includes qualifications of Degree level and above. Please state the actual number for each field. Personal details of individual officers are required, actual numbers).

OUR land, estate or property management;

Urban studies;

Planning;

Business or management studies;

16. Does the council carry out risk assessments, before any eviction is due to commence?

17. What is the actual number of disabled persons evicted in the past 10 months? This includes any man/woman with learning difficulties, e.g autism, Down's Syndrome, dyslexia, chronic illnesses, e.g diabetes, and mental health issues or impairments, e.g bipolar or suicidal tendencies. No personal details of any former tenants are required, simply that the actual number is quoted.

18. What is the actual number of telephone calls made by the Council to the [Name of Police Force], to attend the scene of an eviction and to assist the council with an eviction? This is including to prevent a Breach of the Peace. However, this also refers to police officers who have assisted locksmiths or bailiffs to gain entry to a property? Please specify as to which reason and then the number of calls.

19. What is the actual number of people who have been found to have committed suicide, due to an eviction/impending eviction by Ceredigion County Council?

20. What is the actual number of people who have been forced to sleep rough, due to an eviction? personal details are required, the actual number of men/woman/children affected.

21. What is the actual number of evictions due to take place from 1 November 2015 onwards? personal details are required, the actual number of men/women/children who will be affected.

22. What is the actual number of court cases for evictions that are going into court from 1 November 2015? personal details are required, the number of men/women/children affected. What are the dates of these hearings? Which County Court or Magistrate court Hearing Centers are these cases due to be heard in? the day, month, year, time of hearing.

23. Is there an agreement in place i.e. a contract with the man/woman /children on taxes as stated in the indigenous law’s and the indigenous constitution’s that you can show as proof.

Dear Sir,

 

Your Freedom of Information request of 13^th October 2015 was forwarded
for my attention.

 

Having consulted with the relevant services I am able to respond as
follows.

 

The Authority is no longer responsible for social housing stock since its
transfer to Tai Ceredigion in 2009 and is therefore not in a position to
evict tenants of these properties.

 

However answers to the questions not relating to evictions are  thus

 

The name of the Section 151 Officer, or the Finance Manager within the
council is  Stephen Johnson – Head of Finance.

 

Each Strategic Director and Head of Service is responsible for the
budgeted income within their own service area. The Section 151 officer is
responsible for Council Tax and Non Domestic rates Collection as well as
the billing and recovery aspects for all Council income that is invoiced.
The post holder is also responsible for all of the Councils accounting and
taxation (VAT etc) matters for all income.

The Council’s  Housing Strategy  Manager is a fellow of the Institute of
Housing and has a degree in Housing. 5 other officers have an NVQ2 in
Housing.
