We acknowledge receipt of your information request received on 8 February
2021 as follows.

In accordance with Section 17 of the Freedom of Information Act, the
Council is required to inform you that the information has not been
provided and has been withheld due to the following exemption under the
Act.

 

Section 40 - Personal Information

It is considered that this exemption under Section 40(2) of the Act
applies, namely that information relating to an individual’s Housing
Benefit account is personal information and all personal details are
protected under the Data Protection Act 2018 legislation.  The Council
cannot disclose personal information where to do so would breach any of
the data protection principles and we believe consent to disclose would
not be given.  In this case the Council believes there is not sufficient
justification to release the information. 

 

The Freedom of Information Act (FOIA) 2000 stipulates that once released
under the Act the data is then public information.  Therefore if this
request was received by any other third party, personal data (including
your own) would be withheld using the ‘Section 40 - Personal Information’
exemption.

 

Although you have quoted the Freedom of Information Act; because this is a
request for your personal data, we would not be able to release this under
FOI legislation.  We would instead treat this as a Subject Access Request
under the Data Protection Act 2018.  However, before we can proceed, we
would require a different private email address from you or a postal
address.  This is because the ‘What Do They Know’ website publishes
requests and responses automatically. 

 

We will also require proof of your ID to verify that we are giving
personal data to the correct person.  You can provide a Passport, Driving
Licence or other form of ID with a photograph and a letter or bill with
your address in person at The Guildhall, Alfred Gelder Street, Hull, HU1
2AA.  Alternatively, you can send your original document of identification
to us via post to The Guildhall (address above); which we will then
photocopy and return to you.  Or you can send a clear photo or scanned

risk. 

 

 

Should you wish to complain about our response in any way this must
