Murder of Diana Garbutt in March, 2010

Dear North Yorkshire Police,

As your force is aware, a third appeal to the Criminal Case Review Commission was recently made by those acting on behalf of Robin Garbutt, convicted in April 2011 of the murder of his wife, Diana, on the basis of further new evidence. It has received widespread press coverage, regionally and nationally.

My own journalistic investigations have a familiar starting point and, accordingly , the following disclosure is requested by way of the Freedom of Information Act:

1. Operational Codename of the murder investigation (believed to be Nardoo).

2. Gold Commander (believed to be ACC Timothy Madgwick).

3. Senior Investigating Officer (believed to be Supt Lewis Raw).

4. Date and time of first entry on policy log (sometimes called policy book or blue book).

5. Date and time of last entry on policy log (ditto).

6. Total cost of operation (Nardoo) up to and including 31st December, 2019.

7. Date review of initial investigation commenced (if any).

8. Operational codename and name of SIO (if any).

Dear North Yorkshire Police (NYP),

This is a request for an Internal Review. The grounds for complaint are:

1. There is a prima facie, and routine, breach of sections 10 and 17 of the Act.

2. The breaches referred to above are deliberate and calculating, thus engaging section 77 of the Act.

3. The matters raised at 1. and 2. are part of a long running and wider campaign by the chief constable of NYP to vex, annoy and harass the applicant - a journalist routinely pursuing his vocation.

4. All rights of civil remedy, including an Application to the Director of Public Prosecutions to privately prosecute the chief constable under section 77 of the Act, and, quite separately, a misfeasance claim, are reserved.
