2. The tender documents submitted by the following suppliers: Adecco, Comensura, Hays, Matrix, Pertemps, Reed

3. The contractual documents you have entered into with the suppliers listed above.

If any of these documents is already available to view online, please can you tell me the appropriate Internet address.

I appreciate that you may need to redact some information from documents such as pricing information, but hope that you will be able to release a reasonable part of all of these documents.

I am writing to request an internal review of Eastern Shires Purchasing Organisation's handling of my FOI request 'MSTAR tender documents and framework agreement'.

On 19 January 2016 I asked for information on the MSTAR2 framework including the tender documents supplied by Adecco, Comensura, Hays, Matrix, Pertemps and Reed. I specifically acknowledged that you may need to redact some information from documents such as pricing information, but also expressed a hope that you would be able to release a reasonable part of all of these documents.

Today I received your response which included all of the information I was seeking on the invitation to tender and framework agreements, but the tender documents relating to the suppliers was withheld entirely. I am asking you to review this decision.

In the letter outlining the reasons for refusing release of these documents, Mr Doherty indicated that information was redacted under section 43(1) on trade secrets, section 43(2) on damage to commercial interests and section 40 on personal data. I have no objection to redaction on the basis of section 40 but am asking you to reconsider whether all of the information provided by the tenderers is covered by section 43(1). Mr Doherty refers to the Section 4 of Part B - Tender Response, the Freedom of Information Exclusion Schedule, which each tenderer would have to complete as part of their submissions, and I would be surprised if every one of the suppliers had designated the vast majority of their tenders as commercially sensitive, and even if they had, that you would simply accept this. For example, the approach in sourcing agencies for the supply chain in SD1 is unlikely to have a large number of particularly innovative approaches that would constitute a trade secret, likewise the approach to continual improvement in SD2. In fact, throughout most of the detailed answers, it is difficult to see where there would be particular approaches used by an agency that would not be well known to other agencies.

I also feel that as this framework was awarded less than a year ago and has at least another year to run (and in practice probably three more), the impact of disclosure is lessened (compared to releasing information at the end of the contract in the run up to a new tendering process).

I would like a review of the decision to redact all of the information in the tender responses which I feel to be excessive against the core purpose of the Freedom of Information Act which is to create a public right of access to information, ie a preference for releasing information, unless there is a strong reason not to do so.
