Dear Janine/Finance.FOI Requests,

I still have not received the information that was requested despite being told multiple times that it will be provided, first on 15th June, then 18th June, and most recently, the end of last week, i.e. 16th July.

Please note that my initial request was dated 15th May, which was over two months ago. Even with the delays due to the coronavirus and the clarification, there is absolutely no reason an FOI request should take this long. The statutory deadline to respond to this request has passed over a month ago, i.e. 18th June 2021.

Please provide the requested information at least by 20th July 2021, failing which I will be forced to put in a complaint with the Information Commissioner’s Office.

•                     We have lots of students who apply in one year (and
have their interview in that year) and then defer their offer to the
following year. For example, they would appear in Q1 (total number of
applicants table) for 2021, but in Q2 (total number of applicants invited
to interview table), they would appear for 2020. Can you confirm whether
it’s ok to present the data in this way?

Whilst UCL is committed to openness and transparency, we are also mindful

We have identified that there is a risk of the identification of
underlying individuals in the information that you have requested.  We
have therefore applied rounding to numbers of individuals to the nearest
multiple of five.  The information withheld is personal information of
third parties, or, if linked with other personal identifiers in the public
domain, would be likely to become personal data.  This information has
been withheld under Section 40(2) of the Freedom of Information Act 2000
(FOIA) by virtue of Section 40(3a)(i).

 

Section 40(2) of the FOIA allows a public authority to withhold
information under the FOIA where (i) the requested information is personal
data relating to someone other than the requester and (ii) its disclosure
would breach any of the Data Protection principles.  In this case, we
believe that the requested information could relate to and identify
individuals and therefore would be personal data.  The disclosure of these
personal data would not be within the reasonable expectations of the

breaches the first Data Protection principle.

 

As the Section 40(2) exemption is an absolute one, there is no need to
conduct a public interest test.
