MS Loans and Credit Checks

Dear Department for Business, Innovation and Skills,

I write with reference to Mortgage-style student loans, originally made by the Student Loans Company under the Education (Student Loans) Act 1990 and Consumer Credit Act 1974 (both as amended).

I would like BIS to provide the express term(s) under any loan agreement (both pre-98 and post-98), Regulations or otherwise that would allow the lender to conduct credit checks at credit reference agencies against the borrower:

i) As part of the deferment application process; and
ii) At any other time.

Dear Department for Business, Innovation and Skills,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Department for Business, Innovation and Skills's handling of my FOI request 'MS Loans and Credit Checks'.

The request contains a properly specified request for information. Furthermore, releasing the credit agreements does not present the information in the form requested.

I would also like to submit a complaint that BIS has not discharged its responsibility to 'respond promptly' in terms of Section 10(1) of the FOIA, given that the 20 working day limit is a 'long stop' only.

I feel it is worth pointing out that both the Student Loans Company and BIS have responded to similar requests, where information has been requested regarding the lender's ability to report loans to credit reference agencies.
