Dear Joao Curro,
I have asked if Mr Andrew Morrell is a practicing solicitor, does ' currently on the register ' mean, he is employed or self-employed as a practicing solicitor with LPC Law, as his details are showing on their website as a skilled solicitors-advocate.

Please confirm if these details are correct or false and whether or not he is employed or self-employed as a solicitor or not ?

Why can you not state if you have had any adverse finding against him ?

Yours sincerely,

Mr. Powell

Dear Mr Powell

Freedom of Information Request – Our Ref: FOI/BS/1456

Thank you for your email below of 03 September and your email of today’s
date to my colleague Joao Curro.

We can only confirm the details on SRA records. Mr Morrell is not
responsible for any information that other people may post about him on
the web, but that information may well be correct. It may well be that Mr
Morrell is a skilled Barrister, but you would have to address that
question to the Bar. It is not something that the SRA would confirm, nor
indeed take any action about if it was incorrect.

Mr Morrell does hold Higher Rights of Audience in the Civil Court and has
done since 2012, and this is confirmed on the Law Society Find a Solicitor
website.

The SRA can confirm Mr Morrell’s chosen areas of work as presently being
Advocacy, Litigation - general, Insolvency and restructuring - business,
Personal injury, because again that is on the Law Society Find a Solicitor
website. It is not at all unusual for a firm’s website to indicate
additional areas of work as they are limited to a maximum of 6 in SRA
records, and they cannot free type, but can only select from a list
produced by the Law Society.

If you have concerns about the conduct of either Mr Morrell or the firm,
you are free to use the SRA report process.

You can send the SRA a report if you have concerns about the conduct of a
law firm or an individual that we regulate.

To send your information to the SRA:

•           Complete the report form and send it to

Solicitors Regulation Authority

The Cube

199 Wharfside Street

Birmingham

B1 1RN

or

•           Email the SRA at [1][email address];

Further information can be found on the SRA website at:
[2]www.sra.org.uk/consumers/problems/report-solicitor.page

You should be aware however, that the SRA does not take forward personal
complaints made against solicitors or firms. If you are concerned about
the service provided by your solicitor or firm you should contact the
Legal Ombudsman. The SRA does not have the power to award compensation for
poor service, or to reduce your legal fees.

If the Legal Ombudsman identifies issues that need the SRA’s attention
they can refer information to the SRA, and it can also refer information
to them. This agreement is set out on the SRA website.

Where there is a failure to comply with the Principles, the SRA takes into
account the risk posed to the public and consumers to help it decide how
best to ensure they are protected. Where the risk posed is serious the SRA
can take formal enforcement action, such as limiting or restricting the
way a solicitor works. In very serious cases, the SRA can close a firm or
ensure an individual is unable to practice in the future.

I hope this information is of use and I am sorry I am unable to assist you
further on this occasion.

Yours sincerely

Dear Joao Curro,

Unfortunately you have still not answered the question that has been asked.

The SRA were not asked whether or not Mr Andrew Morrell is a skilled Barrister and were only asked to comment on his employment covered by SRA as you regulate both LPC Law Ltd and Mr Andrew Morrell.

So can you please answer whether he is employed as a practicing solicitor for LPC Law Limited or if he is a self-employed practicing solicitor for LPC Law Limited and whether acting as a solicitors-advocate or in some other capacity ?

Yours sincerely,

Mr. Powell

Dear Joao Curro,
I understand you say you have no current employment details listed for
Mr Andrew David Morrell (SRA number 494232), even though you have the current public links showing his details on LPC Law Ltd website listed under their Solicitor & Solicitor-Advocate profiles.

My question also included previous employment details for Mr Andrew Morrell working for LPC Law Ltd.

Are you saying that you have no employment details for Mr Andrew Morrell working as a solicitor or solicitor-advocate including working for LPC Law Ltd ?

Are practicing solicitors not required to confirm their employment details with SRA ?

When did Mr Andrew Morrell stop practicing as a solicitor or solicitor-advocate ?

Yours sincerely,

Mr. Powell

Thank you for your email.

The SRA database does not confirm the details that you have reproduced
from the web site. The SRA database does not show Mr Andrew Morrell as
working as a solicitor for LPC Law Ltd at present.

Under the provision of section 84 of The Solicitors Act 1974.
[1]http://www.legislation.gov.uk/ukpga/1974... , the solicitor
must notify the SRA within 14 days of the change of employment. If he is
not working for the firm as a solicitor, the SRA does not require a
notification.

Mr Morrell ceased to hold a Practicing Certificate on 31/03/2015.

I hope this information is of use.

Dear Joao Curro,

Thank you for confirming Mr Andrew Morrell ceased to hold a Solicitors Practicing Certificate on 31/03/2015, can you therefore please confirm whether or not he gave notice of a change of employment, as he is still listed on the LPC Law Ltd website as a skilled solicitor-advocate under the list of Advocate profiles.

How is it possible he is still working for LPC Law Ltd as a skilled solicitor-advocate without a Solicitors Practicing Certificate.

Yours sincerely,

Mr. Powell

Thank you for your email.

We are unable to confirm whether or not Mr Morrell gave notice of a change
of employment as this falls under Section 16 of the Code. This section of
the Code states that we cannot disclose personal data. To do so would be a
breach of the Data Protection Act 1998.

If you have evidence that Mr Morrell is practising as a solicitor without
a current practising certificate, then you are very welcome to report the
matter to the SRA using the usual report process. This can be found here:
