The state of the M25 contradicts your statements and I note an annotation to my request with a link to info' that indicates the issue is ignored. Concerning the M25 for the past 3 years:
1. How often has the contractor cleaned litter from motorways?
2. What are the Environmental Protection Act and the associated ‘Code
of Practice’ rules for clearance, the code of practice?
3. What are the contracted periods for clearance?
4. provide the general maintenance inspections along the motorways on a daily or weekly basis.
So they make inspections but don't clear.
5. What are the timescales required by the code of practice to 'make arrangements' to clear the litter.
6. What are the timescale to remove the litter
7. what info' do you have about this and compliance?
8. Why do you want litter cleaned what are the reasons for this and supply all information about it.

Thank you for your further email to the Highways England Customer Contact Centre of
17 April regarding information in relation to the M25 maintenance. I have handled your
enquiry under the Environmental Information Regulations 2004.
I have responded to each of your requests in the order that you requested them:
1. How often has the contractor cleaned litter from motorways
We carry out a litter survey of our entire road network every seven days, with scores
allocated according to grades of cleanliness, based on recommendations detailed in
the Environmental Protection Act (EPA).
Definitions of grades of cleanliness are detailed within section 7 of the ‘Code of
Practice on Litter and Refuse’, which is available here:

For those sections of the network that score a Grade C, we have a period of 28
days to rectify and return it to an acceptable condition. Should any sections be
scored as a Grade D, then they must be cleared within seven days.
2. What are the contracted periods for clearance?

4. Please provide me with the compliance measures
The M25 DBFO Contract payment mechanism is based on network availability and
condition with adjustments related to congestion and safety outcomes. There is no
direct mechanism to apply financial penalties for failure to collect litter.
However, the contract does include a mechanism for awarding performance points
where service levels are in breach of contractual obligations. This covers failure to
collect litter within the timescales set out in the DEFRA Code of Practice on Litter
and Refuse. When these accumulate they trigger various sanctions under the
contract.
Additional information
For health and safety reasons, carrying out litter picking on the network is also subject
to access constraints. It’s often necessary for the work to be carried out under slip road
or lane closures, to provide a safe working area for our workforce. We therefore
schedule the work into our planned maintenance programme as this coordinated
approach also maintains lane availability for traffic.
We keep a record of the quantity of litter that’s collected and where it’s collected from.
This information also supports our work programming and resource allocation.

I have written to the DfT with a copy to Roads Minister, Jesse Norman MP, explaining that the inspections are one-off checks on a supposedly random 5km stretch of carriageway in which each km is given an average grading for litter.

As there are no follow up inspections of the same stretch they cannot therefore check if litter has, or has not, been collected within in any time scale.

I have pointed out that the claims made to myself, Baroness Randerson, and MP Robert Halfon were therefore misleading.
