MotD Statistics for FFC vs Wigan Athletic 30 30 October 2010

The request was partially successful.

Dear British Broadcasting Corporation,

Please can you provide all pertinent information which can explain how you programme Match of the Day produced dramatically different statistics from those recorded on the BBC website for the Association Football Premier League match between Fulham Football Club and Wigan Athletic on the 30 October 2010. For instance possession was recorded as 56% - but BBC online has it as 65%. MotD said Fulham Football Club had 1 shot on target and 2 shots off target whilst BBC online provided the figure 9 shots on target and 6 off target.

If the statistics are gained from different sources can you please provide a full justification for this policy and the amount payed by the BBC to the organisations providing the statistics.

Could you please provide a list of all errors made in the coverage of the Fulham Football Club Wigan Athletic match on 30 )October by the BBC, can you ensure you clearly distinguish between MotD and BBC online when providing this information rather than providing a simple list of errors from all services provided by the BBC. In each case can you name the cause of the error.

In the case of individual error can you note the action taken against the individual, without imparting his identity as i have no wish make the BBC liable to the effects of the Data Protection Act

Yours faithfully,

Harry Raffal

Can you please note the percentages for possession cited in this request refer to FFC's possession with Wigan making up the percentage to 100

Also I should of course of have said his or her identity when referring to individual error i do apologise for assuming it would be a gentleman.

Yours,

Harry Raffal

Dear FOI Enquiries,

Thank you for your response dated 17 November 2010.

I'm afraid i cannot be anything than distinctly dissatisfied by your response. I appreciate certain aspects of the information might be covered by
Part VI of Schedule 1 to the Act provides that information held by the BBC and the other public service broadcasters is only covered by the Act if it is held for ‘purposes other than those of journalism, art or literature”

I appreciate you're volunteering of certain informations and would like to express my thanks in association with this.

However, your failure to provide a list of factual errors for this match would not not seem to be covered by this clause. I think if you actually review the footage you'll notice that there are more than the errors I outlined in my request. For example when Mark Hughes was speaking at the end of the match the score was recored as 0-0. If the BBC was genuinely concerned with ensuring the appropriate lessons are learnt in future.
Furthermore I believe that any disciplinary action or retraining to the individual responsible would not be covered by this clause, if you disagree can you please give an explicit explanation why not. Please not if exact details would be covered you can indicate this and merely say that a certain form of action has been taken.
I have no wish to appeal to the Information Commissioner given the lengthy process and the potentially unnecessary costs to a public service. I therefore hope you will address this information.

Yours sincerely,

Harry Raffal

FOI Enquiries, British Broadcasting Corporation

Dear Mr Raffal,

I refer to your email of 18th November in relation to the reporting
discrepancies between Match of the Day and BBC Online's coverage of the
Fulham v Wigan match of 30th October 2010. Specifically, you

(i) comment on our 'failure to provide a list of factual errors' and
that this would not seem to be covered by the derogation, and
(ii)request an explanation as to why any disciplinary action falls
within the derogation.

In relation to (i), I can confirm under section 1(1) of the Act that the
BBC does not hold a list of the factual errors/discrepancies between BBC
Online's coverage and Match of the Day's coverage.

Your correct recourse for any query regarding the application of the
derogation is by appeal to the Information Commissioner's Office, whose
contact details are:

Information Commissioner's Office,
Wycliffe House,
Water Lane,
Wilmslow,
Cheshire
SK9 5AF

Telephone: 01625 545 700.
Website: http://www.ico.gov.uk

Please note that should the Information Commissioner's Office decide
that the Freedom of Information Act does cover this information,
exemptions under the Act might then apply.

Yours sincerely

Dear FOI Enquiries,

I am requesting a full internal review of your decision to refuse details of any disciplinary action in the Freedom of Information request referenced RFI20101463 by utilising Part VI of Schedule 1 to the Freedom of Information Act; providing that information held by the BBC and the other public service broadcasters is only covered by the Act if it is held for ‘purposes other than those of journalism, art or literature”

Please take this as a formal request for an internal review. I previously discussed this issue and was advised that the appropriate action was to contact the Information Commissioner's Office. This is incorrect I should only contact the ICO after fully exhausting the internal complaints procedure of the BBC, including in cases of qualified exemption. I would appreciate the internal review also analysing why I was provided with advice which appears to be factually incorrect.

Yours sincerely,

Harry Raffal

Dear Mr Raffal,

Thank you for your email of 14th December 2010 in response to my email
of 30th November.

I can but reiterate that your correct course of appeal is with the
Information Commissioner whose contact details are:

Information Commissioner's Office,
Wycliffe House,
Water Lane,
Wilmslow,
Cheshire
SK9 5AF

Telephone: 01625 545 700.
Website: http://www.ico.gov.uk

This direct course of appeal, when the derogation is applied, has been
agreed by the Information Commissioner and the BBC.

Dear FOI Enquiries,

Thank you for your recent response to my request for an internal review.
Can you categorically state that the BBC considers I have exhausted its internal complaints facility? I apologise if this seems unnecessary to you but the Information Commission makes it clear that only when all internal processes have been exhausted should they be contacted and I have no wish to apply to them only to be told a month later I failed to do conduct this complaint in the correct manner. Again I apologise if this merely requires you to answer yes the BBC considers all internal procedures have been exhausted.

Yours sincerely,

Harry Raffal

FOI Enquiries, British Broadcasting Corporation

Dear Mr Raffal,

Thank you for your email of 21st December as outlined below.

As explained in my email of 30th November 2010, in relation to the first
part of your request, the BBC does not hold a list of the factual
errors/discrepancies between BBC Online's coverage and Match of the
Day's coverage.

In relation to the second part of your request, if you are unhappy with
our response your correct recourse is to the Information Commissioner.
The BBC can carry out Internal Reviews when the information falls within
the scope of the FOI Act, but when the information falls outside of the
scope of the FOI Act, ie. the derogation for 'journalism, art, or
literature' applies the correct recourse of action is direct to the
Information Commissioner (details provided below).

Should the Information Commissioner decide that the derogation does not
apply to your request re: disciplinary action, and the request falls
within the scope of the FOI Act, exemptions under the FOI Act may apply.

I am sorry that you are unhappy with our reply and that we are unable to
assist you further.

Yours sincerely
