In response to Kevan Jones‘ written parliamentary questions (96791 & 96792) regarding BEIS’s oversight of the financial, reputational and strategic risks posed by Post Office Ltd‘s Horizon Litigation, Paul Scully replied (7th October, 2020):

‘The Post Office Limited’s Horizon IT system litigation has been considered by both the Performance and Risk Challenge Panel and the Performance and Risk Committee as part of the Committee’s considerations regarding its Performance and Risk report’.

i) Please can you identify on how many occasions and on what dates POL’s Horizon Litigation was considered by both BEIS’s Performance & Risk Challenge Panel and BEIS’s Performance & Risk Committee?

ii) Please can you disclose relevant minutes of the above meetings at which these risks were considered?

iii) Please can you disclose relevant passages of the Committee’s Performance and Risk report/reports pertaining to POL’s Horizon Litigation and identify to whom this report was circulated?

iv) Please include dates of all relevant material.

Thankyou for you response of 12th February seeking clarification of my FOI request 2021/02606

I am particularly interested to read the report to which Postal Affairs Minister, Mr Paul Scully, refers in the quotation cited in my original request: it would appear from his remark that there is one report by the department‘s Performance and Risk Committee pertaining to the risks posed by Horizon Litigation. I would therefore be most grateful if you would release it.

If it transpires that there are more reports by the Performance and Risk Committee which assess the potential impacts of POL’s Horizon issues, and if you are able to locate them within the appropriate cost limit of my request, then I would be most grateful if you could also disclose:

1: Any BEIS Performance and Risk Committee Minutes/Report which made a risk assessment in response to the final findings of independent investigators Second Sight. (Second Sight’s ‘Briefing Report - Part Two’ of April 2015 led the department to commission POL to undertake a review of Horizon in September 2015).

2: Any BEIS Performance and Risk Committee Minutes/Report which address the potential impacts of POL’s Horizon Litigation from the time of the Group Litigation Order of March 2017 up to and including the present action at the Court of Appeal.

Dear Information Rights and Records Unit.

Thankyou for your email of 13.05.21 regarding my FOI request concerning the BEIS’s oversight of the Post Office via its Performance and Risk Challenge Panel and Performance and Risk Committee (2021/02606). This request was originally submitted on 23.01.21.

I was asked to clarify the request on 12.02.21 which I did on 13.02.21, it was given a new reference number, 2021/05396.

On 15.03.21 I was told the response would be delayed until 14.04.21. On that date I was informed there was to be a further delay until 13.05.21. On that date I was informed there was to be a further delay until 21.06.21.

My initial request has taken so long for you to process that developments relating to the BEIS’s oversight of Post Office’s Horizon issues necessitated a separate, follow-on request which I submitted on 14.04.21 (2021/10605). On 13.05.21 I was informed that this too would be delayed until 11.06.21.

Whilst I appreciate the need to reach a decision on the balance of public interest, I do not believe these repeated delays comply with FOI request procedures and I have little confidence that the new June deadline will not be postponed once again.

I therefore request an internal review into the handling of both requests.
