Environmental Information Regulations 2004

Thank you for your request for information received on 3 May 2024.

Part of the information which you are seeking has been assessed as
commercially sensitive. It is therefore a qualified exemption by virtue of
Section 12(5)(e) of the E nvironmental Information Regulations and
requires the public authority to apply a public interest test. This is
where it needs to balance the public interest in disclosing the
information against the public interest in withholding it. A public
authority can only refuse to provide the information if it is satisfied
that the public interest in withholding the information outweighs the
public interest in disclosing it. In order to apply the public interest
test a public authority is permitted a further 20 working days in addition
to the standard 20 working day deadline set out in the Regulation.

The Environmental Information Regulations 2004 obliges us to respond to
requests promptly, and in any case no later than 20 working days after
receiving your request. However, we now need further time in which to
consider the public interest in disclosing the information.

We estimate that it will take an additional 20 days to take a decision on
where the balance of the public interest lies. Therefore, we will respond
to you by 27 June 2024.
