Thank you for your recent enquiry regarding information held by the East
Suffolk and North Essex NHS Foundation Trust:

 

What is the latest available figure for the amount paid to your trust by
Bounty?

 

Your enquiry has been dealt with in accordance with the Trust’s Freedom of
Information Act 2000 Policy and Procedures.

 

We confirm that we hold the information requested.  However, we regret to
inform you that your request has been unsuccessful and therefore the Trust
will not be releasing the information requested.

 

Under the terms of the Freedom of Information Act 2000, there are certain
circumstances when Trust information will not be disclosed.

 

We regret to inform you that your request has been unsuccessful and
therefore the Trust will not be releasing the information requested. This
information is exempt under Section 43(2): Commercial Interests.

 

It is considered that the release of such information would place the
Trust at a commercial disadvantage by restricting its negotiating powers
for future contracts.  The Trust recognises there is a public interest in
ensuring public money is spent wisely and that value for money is
achieved.

 

However, the Trust believes the disclosure of this information would
severely undermine its ability to achieve value for money from public
funding. In all the circumstances of the case, the public interest in
maintaining the exemption outweighs the public interest in disclosing the
information.

 

If you are unhappy with the service you have received in relation to your
request you should write to us in the first instance.

 

Any complaints you wish to make in relation to Environmental Information
Regulations (EIR) requests, must be sent to us within 40 working days of
receipt of this letter.

Policy and Procedures.

 

The Section 43: Commercial Interests exemption still applies.

 

The pricing is based on individual negotiations and the sharing of
Bounty’s pricing structure would make it difficult for Bounty to meet each
hospitals’ individual needs.

 

The sharing of this commercially sensitive information may mean a Trust
breaching its contracts with Bounty, but, more importantly, may prejudice
Bounty’s and the Trust’s commercial interests which may lead to increases
in the cost of Bounty’s access to hospitals. This in turn might affect
Bounty’s ability to offer services to some small hospitals, possibly
resulting in cuts to their income and mothers missing out on important
free information and valuable sample packs.
