Dear Andrea Swan,

 

Thank you for your request received 28/9/18 which is being dealt with
under the Environmental Information Regulations 2004 (EIRs) for ‘how much
has been spent on flood defences over the last 5 years’.

 

Under Regulation 12(4)(c) of the EIRs the Council can refuse to comply
with a request that is formulated in too general a manner.

 

The Council is unable to identify the information you have requested from
the details in your request.

 

Please provide the following additional information, so we can search if
we hold the information requested.

 

I would like to know how much has been spent on flood defences over the
last 5 years.

 

Does this relate to new capital works or maintenance works?

 

Which organisations are included ie DCC or DCC & Environment Agency EA?

 

What is your definition of a flood defence? 
In addition, I would also like to find out how much the council has spent
repairing flood damages.

 

What is your definition of flooding and what sources of flooding are to be
considered?

 

 

We won’t be able to deal with your request until you provide the
additional information.

The EIR Regulations says that we must comply with your request for
information within 20 working days, from the date following receipt of
your request unless we have to ask for clarification, as in this case. 
The 20 day response deadline clock has stopped from the date of this
email, the clock will reset from the date we receive your response
clarifying your request and we will advise you of the new 20 working day
deadline at this stage.

Unfortunately, if we don’t hear from you by 3 December, we will send you a
refusal notice because we have not received all the information we need to
deal with your request.

Dear Andrea Swan,

 

I refer to the email sent to you on 3/10/18 asking you for more
information to help us deal with your request about ‘flood defences’. 

 

Unfortunately, we have not received a response by the 3/12/18 response
deadline and this email is a refusal notice.

 

Exception Regulation 12(4)(c) Request to General applies

 

This exception applies because your request does not provide all the
information we need to search if we hold the information requested.

 

As this is a ‘qualified’ exception we have applied the ‘public interest
test’. This means we have, in all the circumstances of this case,
considered if the public interest in disclosing information outweighs the
public interest in applying the exception. We have found that, on balance,
the public interest lies in favour of upholding the exception.

 

We recognise that there may be some public interest in information about
‘flood defences’ in the city.  But this is outweighed by the public
interest in ensuring the efficient and effective use of public resources.
It would not be a good use of our limited resources to guess what
information you require and to then spend time locating, retrieving and
providing information which may not be what you are actually looking for.

 

However, if you wish to submit a new request which more clearly describes
the information you are looking for, we would be able to consider your
request and respond in accordance with the EIRs.

 

If you are unhappy with this response to your request, you can ask us to
carry out an internal review.  Please put your appeal reasons in writing
and send it within 40 working days to…
