Moelfre City Byway - PCC Signage

Dear Powys County Council,
A visit to Moelfre City Byway LB645 will confirm that PCC have still not actioned removal of the highway/carriageway obstruction at Little Moelfre farm to restore open public access to an amenity that was enjoyed since living memory until 2 years ago.

An internet search of 'Moelfre City Byway' produces two videos taken by users of the Byway.

At the end of the trail riding video dated 15 April, 2015, at time 17.15 of 17.18, on the right hand side of the picture is a Powys County Council metal signpost, to be viewed when approaching on the District Road, with three metal signs attached and an adjacent Council wooden Byway finger post.

In the 4x4 video dated 5 August, 2017 at time 1.01 of 3.51 the metal signs have been removed from the post; the large gate has been relocated and padlocked; the bridle gate has been removed and replaced by an obstructing fence located on a new line ahead of/below the signposts instead of behind/above them.

My Request:

1. Please advise the dates when Powys County Council or it's authorised contractor installed the metal signs and bridle gate.
2. Please advise the dates when Powys County Council or it's authorised contractor removed the metal signs.

To assist locating the information the metal signs are known to have been removed before 19 May, 2016.
Approximate dates are acceptable if necessary. Date of bridle gate removal is already known.

Moelfre City Byway

This is to inform you that your request has been considered and I can
provide the following response:

required to inform you

1 (a) whether the information requested is held by the public authority,
and

(b) to have that information communicated if that is the case.

In this case the information requested is not held.

 

2.         Please advise the dates when Powys County Council or it's
authorised contractor removed the metal signs.

- No Information held

Under Section 1 of the Freedom of Information Act a public authority is
required to inform you

1 (a) whether the information requested is held by the public authority,
and

(b) to have that information communicated if that is the case.

In this case the information requested is not held.

However a survey comment dated 8th November 2017 states “Fingerpost
removed following withdrawal of permissive access along farm track.” It is
not known if that was the actual date of removal, or simply the date when
the survey was carried out and the fingerpost noted as having been
removed.

 

To assist locating the information the metal signs are known to have been
removed before 19 May, 2016.

Approximate dates are acceptable if necessary. Date of bridle gate removal
is already known.

 

We are required to provide a response to this request by the due date of
08/06/2018

 

We believe that this request is now complete and shall be closed

Dear Information Compliance (CSP - Generic),

Thankyou for your response.
Assuming due diligence and the accountability of work records by the relevant officers of PCC Countryside Services and Highways departments, the fact that no information is held by them strongly suggests that removal of the Council signs and Byway fingerpost was unlawful.
This raises further questions for Powys County Council.

As requested, these will be put to PCC in a fresh Freedom of Information request.
