For the most recent 12 month period available, please provide the following information based on the deployment of camera vans and any similar equipment. Please exclude data gather by "officer initiatives".

• The locations at which any form of traffic speed monitoring by the police took place.
• The corresponding dates, times and duration.
• The type of equipment deployed.
• The total number of vehicles observed each time.
• Whether or not each of these locations had been subject to any form of traffic calming previously.

Dear Leicestershire Constabulary,

I am writing to request an internal review of Leicestershire Constabulary's handling of my FOI request 'Mobile Speed checks (2)'.

I believe your attempt to avoid answering the second element in my request is unfounded :
1) The dates and times are already in the public domain as the tickets issued to drivers show both. Also many of the drivers not issued with a ticket will have noticed the police presence, so the exercise is hardly a secret.

2) Given limited resources, the police strategy must rely heavily on unpredictability and this will not be achieved if dates/times follow some sort of pattern – motorists are not stupid and if there is any degree of regularity they will soon twig. You are however indicating that in disclosing historical dates/times the information could be used as a reasonable predictor of future activity, which would be absurd if it were true and totally undermine the purpose of each exercise. I do not believe it is true and therefore there is no reason for you to withhold ANY of the information I have requested.

I am the Disclosure Manager for Leicestershire Police and I have conducted
the internal review of the decision to refuse access to the data made in
your original request.

 

Considerations of the review

 

As part of the review I have examined all elements of your request and
note that the response letter fell outside of the 20 working day deadline
for which I apologise on behalf of Leicestershire Police. Your rationale
for the appeal focuses on the argument that our Freedom of Information
Officer errored in law when she decided to apply the exemptions.

 

Having reviewed the arguments for the application of these exemptions set
out in the response letter, and your comments, I must advise you that your
appeal has not been successful on this occasion.

 

Reason for decision

 

The use of the exemption on this occasion has been clearly set out in the
original response letter and I note that you focus your argument on the
fact that policing should be unpredictable and therefore individuals
shouldn’t be able to spot patterns in policing. However, the indication we
have from the relevant stakeholders is that if we were to regularly make
disclosures of this nature and place them in the public domain it is
viable that such patterns could be established and therefore policing
would be affected. As a result I must uphold the application of Sec 31 on
this occasion.

 

On this occasion I therefore do not believe that your appeal is
successful. I apologise for the length of time taken to respond to your
appeal and remind of your right to address further appeals to the
Information Commissioners Office who will give them due consideration.
