FoI, North Wales Fire and Rescue Service

Dear Sir,

 

Further to your recent request to North Wales Fire and Rescue Service
(NWFRS) made under the terms of the Freedom of Information Act regarding
the cost of the Service’s mobile data software solution, NWFRS confirms
that it holds this information but believes it to be exempt under Section
43 (Commercial interests) of the Freedom of Information Act.

 

Section 43(2) of the Act states that information is exempt information if
its disclosure would, or would be likely to, prejudice the commercial
interests of any person (including the public authority holding it). It is
the opinion of NWFRS that:

 

(a)    Disclosure of information relating to prices would, or would be
likely to prejudice the commercial interests of its current supplier in
future tenders, including but not limited to real and significant
prejudice to and competitive advantage over them in connection with the
forthcoming combined bid for MDT services with NWFRS, South Wales Fire and
Rescue Service and Mid and West Wales Fire and Rescue Service.

 

(b)    This information is relevant to how the current supplier does
business, not just in this particular case, but in future commercial
activity. Were this information made available to a competitor there is a
real and significant risk that such a competitor would be in a better
position to compete in future bids. This would be an unfair advantage as
the current supplier would not have had access to equivalent information
about its competitors.

 

(c)     Competition is the essence of the public tendering process. There
is real and significant risk of prejudice in respect of the current
combined bid for MDT services with the three Welsh Fire and Rescue
Services, and disclosure may also dissuade parties from participation in
future bids, leading to less competition and increased costs. Disclosure
of the pricing information may, therefore, prejudice North Wales Fire and
Rescue Service’s own commercial interests.

 

(d)    Rather than serving the public interest, a disclosure of this
nature may would enable competitors in the market to gain unfair advantage
over the current supplier, undercutting them by the smallest possible
margin in future competitive bids and, therefore, adversely affecting the
legitimate economic and confidential interests of the supplier.
