Dear Wirral Metropolitan Borough Council ('the Council'),

Today I visited.....by appointment.......the Council's Planning Department, to view the Planning File for Planning Application APP/16/00823, ASHTON COURT, West Kirby.

I understand that there has been correspondence between Mr N Williams, Senior Planning (Section 106) Officer, and Lisa Newman, regarding the APP/16/00823 planning application.

It is clear that Stella Edwards ( Principal Strategic Housing and Investment Officer) has seen the letter.....yet a copy was NOT in the planning file that was shown to me, today at the Council's Planning Department.

I was under the impression that the Council had a LEGAL OBLIGATION to make available, on request, planning files for members of the public to view. The obligation applies to the WORKING, genuine planning files, NOT SHADOW, incomplete 'planning files'.

Why was the letter from Mr N Williams and Lisa Newman "regarding the above application", NOT in the planning file that I was show?

Please provide a copy of the Mr N Williams to Lisa Newman.

We write further to the above requests for information and confirm that
the Council’s response below is made in respect of both enquiries.


·         “Please provide information (including ALL
correspondence/emails) of all inquiries and investigations made by the
Environmental Health Officer regarding the possibility of ASBESTOS being
present in the Ashton Court buildings and, if there is ASBESTOS in the
buildings, of ALL measures proposed by the Council's Environmental Health
Department to ensure that there is NO disturbance of any ASBESTOS into the
local environment if it becomes necessary to remove any ASBESTOS.”


Wirral Council’s Environmental Health Department has received no
complaints regarding asbestos at Ashton Court or Ashton Drive and there is
no requirement to routinely check all buildings prior to demolition.
Responsibility for ensuring that demolition contractors fulfil health and
safety at work duties for issues such as asbestos would fall to the Health
and Safety Executive.  The Council holds no recorded information in
relation to this request.
