Misconduct in Public Office - North East Lincolnshire Council

Dear Mr outlawlgo,

I am in receipt of the documents and the new complaint form you have sent us. This is the same issue that Mr Upjohn decide and about which we have already correspondence. So it is not a new complaint and we will take no further action.

To repeat what I said in my last mail to you. As a publicly funded body we cannot justify continuing to correspondence about complaints we have decided. You have been told how to ask for a review of the decision on your case. If you do that we will respond to you. We will also reply to any legal action or DPA/FOI requests. Other than that any further correspondence from you about this complaint will be read, but not acknowledged or replied to.

LOCAL GOVERNMENT OMBUDSMAN

The LGO was advised the same day (12 August) that it was in fact a new complaint about misconduct in public office. There has been no acknowledgement by the LGO to being informed that it had made a mistake in its initial review.

Q. Please disclose records held by the LGO regarding this complaint. Is it being dealt with, or has it been referred to the police for example.

Dear Foi Officer,

Re, "However, if the complainant concerned wishes to receive information about this case, they should make a subject access request under the Data Protection Act and we should be able to provide the information. This would need to be made in private and not via the What Do They Know website."

i) If a Subject Access Request is submitted is it likely that the full 40 working days will be taken advantage of to disclose the information,

ii) will there be a charge, and

iii) would it be best to ask for all the information held by the LGO regarding the complainant so there is neither ambiguity nor need to submit another?

In response to your questions:

1. We aim to respond to subject access requests within 20 working days. How long it takes within that time depends on how many other requests we have to deal with at the same time.

2. We do not make a charge.

3. How much information is requested by the complainant is a matter for them. People who have made more than one complaint to us often ask for information on all of them, but the more information there is, the more likely it is that it will take a longer time to respond.
