by trade union reps?

What is your policy in dealing with misconduct by trade union reps?

Is the data you are supplying for all misconduct cases or those which are
formerly recorded?

Dear Abdul Hai, 

Thank you for your e-mail of 24^th February where you requested
information regarding Misconduct by trade union reps since 2022. We have
dealt with this under the Freedom of Information Act 2000 and in line with
our Freedom of Information Act policy which can be found at:

We have now completed searching for the information you requested. 

A copy of the information, which can be disclosed, is enclosed below.

• 1 x misconduct case
• 1 x has been the subject of 3 separate low-level misconduct
investigations in the past 12 months
• 1 x -  concerns regarding  a conflict of interests with a rep and
their approach and behaviour towards the head of school but this was
resolved informally and the situation has now improved

We log both formal and informal cases.

Our approach for dealing with misconduct is the same as all employees as
set out in our disciplinary  policy.  However we will not take
disciplinary action against a trade union representative until an employed
official of that trade union has been consulted.

If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review. Internal review requests should be
submitted within two months of the date of receipt of the response to your
original request and should be addressed to Data Protection Officer,
Thinking Schools Academy Trust, Park Crescent, Chatham, ME4 6NR or via
email to [2][email address]. 

If you are not content with the outcome of the internal review, you have
the right to apply directly to the Information Commissioner for a
decision. The Information Commissioner can be contacted at: Information
