I write further to your request below for information and your recent
email dated 13 May 2021 requesting an internal review.

 

As you can see from the emails below, on 19 April 2021 we acknowledged
your email of 15 April clarifying your original request and informed you
that our deadline for responding to your new request was 14 May 2021.
 Your request for an internal review is therefore premature as we received
it before the expiry of the 20 working days deadline stipulated by the
Freedom of Information Act 2000.  

 

We have now considered your request and I have set out our response below.

 

1) All minutes of any meetings between Sport England and The Active
Wellbeing Society - a Community Benefit Society organisation number 7595,
also known as TAWS Trading Ltd, from January 2017 to present date.

We do not hold the records of any meetings between Sport England and The
Active Wellbeing Society from January 2017 till the present date.  Our
records show that we made two exchequer awards to Birmingham City Council
to help review options and to develop a business plan for the TAWS
service. The awards details are below - for both commissions the City
Council employed FMG Consulting:

 

2016000571 – Wellbeing Service Financial Model and Capital Investment Plan
(£10,000)

 

2017000651 – Wellbeing Service Options Appraisal (£20,000)

 

The City Council organised a couple of workshops to gather the information
that FMG Consulting required to complete the reports and we hold some
correspondence we had prior to and post the workshops together with some
reports.

2) All minutes of any meetings between Sport England and Birmingham City
Council from January 2017 to present date.

 

Having carefully considered this aspect of your request, we have
determined that the cost of providing the information you have requested
would exceed the appropriate limit set out in the Freedom of Information
Act 2000 (FOI Act) and the Data Protection (Appropriate Limit and Fees)
Regulations 2004. We are therefore unable to comply with your request by
virtue of section 12(1) of the FOI Act.

 

The appropriate limit for Non-Departmental Public Bodies, such as Sport
England, is currently set at £450 which represents the cost of one person
spending more than 18 hours identifying, locating, retrieving and
extracting information falling within the scope of a request.  We have
identified that the information you are seeking could be held by several
officers in various teams and have estimated that it would take officers
in excess of 100 hours to locate and identify some of the information.

 

In order to assist you and give you an idea of the scale of the
information that you have requested, I should explain that numerous
colleagues (past and present) from various teams will have met with BCC
for various reasons (e.g. commonwealth games, facility investments, local
delivery pilot work) over the past four years. Conservative estimates of
the number of meetings between Sport England and BCC Officers over the
past four years are well into the hundreds. In total we have estimated
that the amount of time required to identify all the information you are
seeking would be over 100 hours which is in excess of the appropriate
limit outlined above.

 

Please note that we might be able to assist you if you are able to narrow
the scope of your request by stating what the subject matter of the
meetings were or if you are able to specify the teams or officers that
might hold the information you are seeking.
