We have been asked to seek a clarification and a time scale from you based
on the following:-
To search for all mentions of the word bid would take this over the 18
hour limit due to it not necessarily being referred to as Peterborough
Positive BID and bid being a common word.
Can we ask that you clarify if you mean meetings that have been led by
'Peterborough Positive' for example and also could we ask for a
timescale as well. This is to try and keep within the 18 hour FOI limit.

BID Body is a private limited company and not subject to the provisions of
FOI legislation. They are a separate entity from the council.

I am writing to request an internal review of Peterborough City Council's handling of my FOI request 'Minutes of meetings for Peterborough positive BID'.
Part of your response was as follows:
"We are unable to release any information as the minutes for the BID
Steering Group meetings we hold were led by Peterborough Positive and not
Peterborough City Council. Peterborough Positive and the BID Arrangements
BID Body is a private limited company and not subject to the provisions of
FOI legislation. They are a separate entity from the council."
Irrespective of who led the meetings, PCC would have a record of the meetings, the PCC have provided the funding for Peterborough Positive and the topics discussed from publicity material are of public interest concerning safety etc. and the use of an APP for incidents and crimes to be reported.
I would be grateful if the response could be reviewed and to assist it is likely that the PCCs Prevention and Enforcement team may be the appropriate department to contact for information as to knowledge and dealings with the BID.

I am writing to request an internal review of Peterborough City Council's

I can confirm that the council’s legal department has carried out an
internal review. As part of that review the legal department has seen all
the correspondence relating to your information request and considered the
applicable legislation before providing advice in this matter.
This letter forms the council’s formal response to your request for a
review. For ease of reference, the details of the initial request for
information and the council’s response are set out below. I will then
confirm the findings of my review.

Your request for an internal review
Your request for an internal review was on the following criteria:
Irrespective of who led the meetings, PCC would have a record of the
meetings, the PCC have provided the funding for Peterborough Positive and
the topics discussed from publicity material are of public interest
concerning safety etc. and the use of an APP for incidents and crimes to
be reported.
Internal review response
Having considered the original request for information, the clarification
provided and the issued response, my internal review response is as
follows.
Peterborough Positive Limited (‘the Company’) is a company limited by
guarantee, independent of the Council. The Company is therefore not
subject to the provisions of the Freedom of Information Act 2000 (FOIA).
Any data the Company provides to the Council is provided under conditions
of confidentiality which means the requested data is exempt from
disclosure under section 41 and section 43(2) of the FOIA. Further
information relating to these exemptions is shown below:
Section 41 - Information provided in confidence
(1)Information is exempt information if,
(a)it was obtained by the public authority from any other person
(including another public authority), and
(b)the disclosure of the information to the public (otherwise than under
this Act) by the public authority holding it would constitute a breach of
confidence actionable by that or any other person.
(2)The duty to confirm or deny does not arise if, or to the extent that,
the confirmation or denial that would have to be given to comply with
section 1(1)(a) would (apart from this Act) constitute an actionable
breach of confidence.
Section 43 - Commercial interests
Section 43(2) provides
" (2) Information is exempt information if its disclosure under this Act
would, or would be likely to, prejudice the commercial interests of any
person (including the public authority holding it)"
While the Council acknowledges it does hold copies of minutes relating to
the Company dated within 2021, the documentation is exempt from disclosure
by virtue of the two exemptions stated above. Correspondence provided by
the Company to the Council have been provided in confidence. Permission to
release the requested documentation has not been granted, either in full,
or extracts, or in part by the Company.
The relationship between Peterborough Positive Limited and the Council can
be confirmed by the First Tier Tribunal in the case of Orr v Information
Commissioner & another 2012, whereby it concluded the above exemptions
were correctly used under the circumstances.
In conclusion, my findings are that I agree with the response provided and
require no further action be taken by the Council.
Please be advised that the Council is currently helping to review the
Peterborough Business Improvement District information page on their
website, to ensure it is fully up-to-date and is informative for our
residents. We will also be working with Peterborough Positive to
encourage them to place more information onto their own website, so that
information can be readily accessed by the public. This work will be
commencing in the coming months and will be reviewed on a regular basis.
What happens now
I trust that this adequately answers your queries, and I now consider this
matter to be concluded. However, if you are dissatisfied with this
decision you may request the Information Commissioner to investigate. The
