REQUEST FOR INFORMATION UNDER THE FREEDOM OF INFORMATION ACT 2000
(‘The Act’)
"Kindly supply copies of complete minutes or notes, where minutes are
lacking, of all meetings between Lexington Communications and Elmbridge
Borough Council Officers and/or Councillors, to include the meeting in
February 2009 referred to in the letter dated 19 February 2007 from
Lexington to the Leader of the Council which you have already supplied
on 22 January 2009 under the FOI Act."

Thank you for your recent request under the 2000 Act made on 23 January
2009 at 20.03, which we formally received on Monday 26 January 2008. As
requested, we are responding electronically.

Please note that to provide this information would involve the
authority incurring cost in excess of the ‘appropriate limit’ as
specified in the relevant Regulations to the Act, as Elmbridge Borough
Council would have to search every file Elmbridge has ever had on any
subject since 1974. Therefore, in this instance, the Council will rely
on the exemption in section 12 of the Act and will not be complying with
your request.

If you were to provide some parameters, for example, limit the
Council’s search by date and subject range, then the Council may be
able to provide this information. Alternatively you may wish to
re-specify your request.

If, for whatever reason, you are unhappy with our response, you have
the right to ask for an internal review. Internal review requests
should be submitted within two months of the date of receipt of the
response to your original letter and should be addressed to Head of
Legal Services, Elmbridge Borough Council, Civic Centre, High Street,
Esher, Surrey KT10 9SD.

Should you then remain dissatisfied at the outcome of that process, you
are entitled to appeal against the decision by contacting The
Information Commissioner's Office, Wycliffe House, Water Lane, Wilmslow,
Cheshire, SK9 5AF.

Dear Mr Brough,

Thank you for your request for information. I apologise for the slight
delay in replying.

I would first point out that there is no record of Council Officers
having any meetings specifically with Lexington Communications. The
latter is a company that the applicants employed for public relations
purposes and I understand they advised or undertook work in connection
with public information and consultation.

There were, however, a number of meetings attended by officers from
Elmbridge at which an employee of Lexington Communications was present
as part of the applicants’ team. I attach details of those where notes
were made.

We do not keep notes or records of meetings that Councillors may have
attended unless there is a specific instruction from a Councillor to do
so. There are none on record in the Planning Division relating to
meetings between any Councillor and Lexington Communications.
