I am writing to request an internal review of Cumbria County Council's handling of my FOI request 'Minutes of meeting of Chief Officers Panel'.

My request was refused the day after it was submitted which leads me to conclude that it was not properly considered.

S 100 C of the Local Government (Access to Information) Act 1985 deals with the inspection of minutes after meetings of Committees. It says:.

(1) After a meeting of a principal council the following documents shall be open to inspection by members of the public at the offices of the council until the expiration of the period of six years beginning with the date of the meeting, namely—

(a) the minutes, or a copy of the minutes, of the meeting, excluding so much of the minutes of proceedings during which the meeting was not open to the public as discloses exempt information;

(b) where applicable, a summary under subsection (2) below;

(c) a copy of the agenda for the meeting; and

(d) a copy of so much of any report for the meeting as relates to any item during which the meeting was open to the public.

(2) Where, in consequence of the exclusion of parts of the minutes which disclose exempt information, the document open to inspection under subsection (1)(a) above does not provide members of the public with a reasonably fair and coherent record of the whole or part of the proceedings, the proper officer shall make a written summary of the proceedings or the part, as the case may be, which provides such a record without disclosing the exempt information

In this case there is no document open to inspection under subsection (1) (a) and neither is there a written summary of the proceedings (minus any exempt information) as required by subsection (2). In fact there is no public record of the proceedings at all - a clear breach of the Act.

Also, the reason for refusal is that the information I am seeking is available to me by other means. Can you clarify what these other means are?

INTERNAL REVIEW ACKNOWLEDGEMENT

 

Thank you for your email received 01 March 2018. This follows the response
that we sent to you on 13 February 2018  in relation to your request about
the Chief Officers Panel.

 

As you are dissatisfied with the way your request has been handled your
request will now be considered through the Council’s internal review
process. The internal review will be carried out by Steve Tweedie,
Information Governance & Risk Manager.

 

The internal review stage is an opportunity to consider the request
afresh. The decision about disclosure made by the council will be
considered, in the light of all the relevant information.

 

Following the internal review the Council aims to respond within 20
working days, in this case by 29 March 2018. If for any reason we are
unable to meet that timeframe we will let you know.
