Minutes of Governing body meetings

Dear JFS,
Please can you supply electronically the minutes of all governors' meetings since my last request on 22nd April this year (https://www.whatdotheyknow.com/request/m...) until the current day. If minutes from sub-committees exist, please can these also be supplied. Please ensure that any minutes that have become available since that date are supplied, even if the meetings were before then.
Also can you provide the total spent on staff, both teaching and non-teaching, both employed directed by JFS/Brent LEA
or agency on a monthly basis for the last 24 months. If this could be broken down into these 4 groups(teaching JFS, non teaching JFS , teaching agency, non-teaching agency) that would be appreciated.

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of JFS's handling of my FOI request 'Minutes of Governing body meetings'.

According to my calculations 20 working days have now elapsed. I have also earlier this week emailed again, but have only had a auto response, with no human acknowledgement since my initial request.
Please can you let me have a response and explain why it has not been within 20 working days.

Thank you for your emails of 13 November and 18 November.  I apologise for
having not replied sooner. 

 

Your original request was received on 5 October and the 20 working day
period for responding to your request expired on 14 November.   

 

As you can appreciate, our advisers are still reviewing the minutes to
ensure we comply with our obligations while maintaining due regard to the
applicable exemptions.  We have also had an OFSTED inspection which has
delayed us attending to this as swiftly as I had hoped.

 

We anticipate that we will be able to respond to your request by 29
November.

I refer to your request for information dated 5 October 2016. Your
requested was as follows:

I enclose the information that the School has decided to disclose to you.
Some information has been withheld, in reliance on the following
exemptions contained within FOIA:

Section 36(2)(b) and (c)

The School considers that the disclosure of some of the information
requested would be likely to prejudice the effective administration of
public affairs, in that it would inhibit free and frank provision of
advice and/or the free and frank exchange of ideas for the purposes of
deliberation. Sensitive matters are frequently discussed at Committees of
the School’s governing body which on occasion relate to proposals for
change at the School that are at a very formative stage and/or other
matters that are of commercial, financial, managerial or other
sensitivity. Those proposals/matters need to be discussed in private in
order that various alternative approaches can be considered and advice
obtained and taken into account. Some proposals may not be progressed.
Where proposals are to be progressed, the School will undertake
publication and consultation in the usual way. In light of the above, the
Chair of Governors is satisfied that the exemptions contained in Sections
36(2)(b) and (c) FOIA are engaged in relation to some of the information
you have requested. The Chair further considers that the public interest
in withholding the information outweighs the public interest in disclosing
it. Disclosure of information about sensitive proposals/matters which has
not been fully considered by the School could cause unnecessary concern
and/or enquiry on the part of our stakeholders. The risk of public
disclosure could also inhibit discussion on the part of the Governing Body
that is necessary for the proper functioning and ongoing management of the
School.

Section 38

Some of the information you have requested relates to security
arrangements in place or proposed at the School. Disclosure of this
information would be likely to endanger the safety of individuals and as
such the exemption contained in Section 38 FOIA is engaged in relation to
that information. It is considered that the public interest in withholding
this information outweighs the public interest in disclosing it. The
School publishes such information as is considered necessary and
appropriate in relation to its security arrangements.

 

Section 40(2)

Some of the information you have requested constitutes the personal data
of identifiable individuals and it is not considered to be fair to put
that information into the public domain. As such that information is
exempt from disclosure pursuant to the exemption contained in Section
40(2) FOIA.

Section 43(2)

Some of the information requested relates to the way in which the School
manages relationships with its contractors. The disclosure of this
information would be likely to prejudice the School’s commercial
interests. The School will determine its approach to its contractors on a
case by case basis, and needs to retain the ability to do so in order to
secure the best value from the contracts it has. As such it is considered
that the exemption contained in Section 43(2) FOIA is engaged in relation
to some of the information you have requested. It is further considered
that the public interest in withholding this information outweighs the
public interest in disclosing it. While it is accepted that there is a
public interest in ensuring that the School manages its contracts
appropriately, it is considered that this is met by information that is
published by the School from time to time.

All other information that falls within your request has been disclosed
and is attached to this email.

This concludes the School’s response to your request. If you are
dissatisfied with this response you can complain to the Information
Commissioner (www.ico.gov.uk).

I note that the minutes from part 1 of the Full governing body meeting on Mon 9th May are enclosed. Please can you elaborate on what is meant by part 1 ? E.g does this mean that there was a part 2 to the meeting ? If so were minutes taken of which none can be disclosed?
