Dear Mr Cahusac

I refer to your request for information dated 25^th January 2011 (email
below).

In 2009 the Court of Session considered an appeal by Glasgow City Council
and Dundee City Council against a decision by the Scottish Information
Commissioner. Basically the Court confirmed that the Freedom of
Information (Scotland) Act 2002 gives the public the right to information
not documents -

"The right conferred by section 1, where it applies, is therefore to be
given the information, rather than a particular record (or a copy of the
record) that contains it. Put shortly, the Act provides a right of access
to information, not documentation." [Court of Session Opinion, Paragraph
43].

The University considers that a request for the minutes of a meeting are
requesting a document and not information and therefore disclosure is out
with the terms of the Freedom of Information (Scotland) Act 2002. Hence if
you would let us know what specific information you are looking for the
University will consider it under the terms of the Freedom of Information
(Scotland) Act 2002.

Dear Mr Cahusac

I refer to your request that the University review (email below, dated
25^th February 2011) its response to your of 25^th January 2011.

In response to the University’s email of 14^th February 2011 indicating
that University was not obliged under the Freedom of Information
(Scotland) Act 2011 to provide you with a copy of documents you indicated
that the information you were looking for from the Minutes was

“I require all minutes of the said meeting that refer in any way,

directly or indirectly, to the renewal of the lease to the

University of Stirling for the use of research space within the

Bioscience Unit at GCU.”

While the University has already provided you with the information you
seek, the minute reads as follows:

" Life Sciences Lease of University
Accommodation

The Executive Board considered a proposal to allow a third-party to lease
University accommodation. It was agreed that the commercial and legal
risks outweighed the potential benefits to the University and consequently
the Board did not support the proposal."[Extract from the Minutes of the
Executive Board Meeting of 2 March 2010]
