As was advised in our original response, the Freedom of Information Act
provides a right of access to information held by a public authority. If
the information being requested is not held by the public authority to
which a request has been addressed, then that authority will issue a
refusal notice. The refusal notice should advise that information within
the scope of a request is not held by the authority and therefore cannot
be disclosed in response to the request.

 

In this case I will reiterate that the information you are requesting is
not held by Cheshire East Council. Therefore it cannot be disclosed by
Cheshire East Council as it isn’t Cheshire East Council’s information to
disclose.

This is because the information you are requested was recorded under the
direction of the Planning Inspector, for the purposes of HM Planning
Inspectorate. Therefore the information is deemed to be held by HM
Planning Inspectorate for the purposed of the Freedom of Information Act.

I can now confirm that the Planning Inspector has now consented to the release of the information you have requested.

Please refer to the two attached documents held by Cheshire East Council on behalf of the Planning Inspectorate which fall within the scope of your request. I can confirm that they are draft notes and may not represent the final version since they have not yet been approved by the Inspector. However, as far as he is concerned they represent the general gist of the discussion on that day.
