1st January 2011 to 16th December 2016.

Please provide:

- Agendas and Minutes for all Extraordinary Governing Body meetings

- Agendas and Minutes for all other Sub-Committee meetings

Dear Mrs Burnside,

Thank you for providing the Governors Meetings Minutes however upon initial examination great swathes of information have been redacted which I believe constitutes a breach of FOI.

Please can you confirm you had sole responsibility for deciding what to redact, the precise FOI Act legislation relied upon also a brief title of information redacted e.g 3rd party names, overspend/underspend figures etc.

It is perhaps worth reminding you the documents provided to me are by law open to public scrutiny and information in them cannot simply be omitted for any other reason if it does not fall within a specified lawful exemption.

There are three Full Governing Body meetings scheduled per academic year,
alongside a Resources Committee per term and a Student Committee.  Dates
and times of these meetings can and do  change as we go through the
year, if the need arises.

Dear Mrs Burnside,

I intend to seek an Internal Review of your decision I have been provided with all documentation in response to my request. This decision is due to the following discrepancies with your account there are only three Full Governing Body Meetings scheduled at Whittington Green School during an academic year:

In 2011 there were 6 meetings
The meeting on 29/11/2011 stated the next scheduled meeting date to be 17/01/2012.

In 2012 there were 4 meetings.
I have not received the minutes from the scheduled meeting of 17/01/2012.
The meeting on 06/03/2012 stated the next scheduled meeting to be 01/05/2012.
I have not received the minutes from this meeting.
The meeting on 11/12/2012 stated the next schedued meeting to be 05/02/2013.

In 2013 there were 4 meetings.
I have not received minutes of the scheduled meeting on 05/02/2013.
I have not received minutes of the meeting in March 2013.

In 2015 there were 4 meetings.
The meeting on 26/01/2016 agreed the minutes of the scheduled meeting on 20/10/2015.
I have not received the minutes from this meeting

I have not received at least five Full Governing Body Minutes as scheduled in the meetings as shown also each academic year between 2011 to 2015 shows more than three scheduled meetings to which you allude.

With regards your redaction of information in accordance with s. 40(2) of the Freedom of Information Act, I believe you usurped your authority in doing so by obliterating information within whole paragraphs which does not constitute personal data of third parties to conceal it knowing it should not be disclosed therein.

I do not understand why you have not received the minutes from 05.02.13,
19.03.13 and 20.10.15 as they were uploaded with the other minutes.  I
have therefore rescanned the documents and attach for your reference.  The
first email being minutes from 05.02.13.

The meetings on the 17th January 2012 and  1st May 2012 were for personnel
issues and are deemed as confidential.

We do not have any records of meetings on the other dates in 2012.

Dear Mrs Burnside,

Thank you for confirming the dicrepancies and providing some of the information required by law.

The Freedom of Information Act does not allow for you to withhold documents because they contain personal issues and are deemed to be confidential.

You must disclose all documents with necessary redactions in compliance with s40(2) where the information contains personal data of third parties where disclosure would breach the Data Protection Act.

Therefore, any information which does not constitute personal data as defined must not be witheld, in this case the entire Full Governing Body Minutes on 17 January 2012 and 1 May 2012.

I ask this information be taken into account during the Internal Review process and for the above mentioned documents to be disclosed forthwith in compliance with the law.

It is only right to point out now that should this not happen I shall have no option but to complain directly to the Information Commissioner.
