Please can you clarify your request for “all prior to this date.” In order
to assess whether we can provide the information within a reasonable time
scale we need to have parameters.  How many years would you like us to go
back?

They were in connection to unpaid Council Tax.

2 statutory demands have been served, 1 by Baring and Co, 1 by MKLS.

costs have generally been £240 for the contractor.

Initial charging order costs have generally been £200 for the contractor.

Our average in-house cost is £241.50.

Why was one bankruptcy carried out in-house and the other contracted out who made this decision and why are people being treated differently, which could be construed as singled out?

I can find no company called Baring and Co what connections do any of your officers have to this company ?

Please provide a complete breakdown of the savings and precisely where they have been made ?

As it does not make sense that it can be cheaper to outsource work when you are paying officers a salary.

We have issued 107 charging order applications for council tax collection
for Tunbridge Wells Borough Council since November 2004 (that is as far as
our records go back).

 

1.    Please provide the figures for your in-house initial bankruptcy
application (statutory demand preparation and service), as you have not
provided these?

 

Apologies, there was an error in our previous response. No bankruptcy
applications have been dealt with internally by Tunbridge Wells Borough
Council.

 

2.    Who is the contractor who has received £240.00 for  initial
bankruptcy application (statutory demand preparation and service) and why
is it cheaper to outsource than deliver your own?

 

The contractor is J E Baring and Co.

 

Mid Kent Legal Services was formed in November 2014.  Prior to this date
the in-house legal team did not have the capacity to take on such matters
and therefore they were contracted out.  It is hoped that this type of
work will be carried out in-house in the future, however, in urgent cases
it may be necessary to outsource due to caseloads.

 

3.    Why was one bankruptcy carried out in-house and the other contracted
out  who made this decision and why are people being treated differently,
which could be construed as singled out?

 

As explained above, the intention is to bring in-house as much of the
legal work as possible, however there will be times that due to capacity
there is a need to outsource.  In addition, where cases  have historically
been dealt with by JE Baring and Co subsequent debts have continued to be
passed to them to ensure consistency.  In no circumstances has anyone been
singled out for different treatment.

 

4.    I can find no company called Baring and Co what connections do any
of your officers have to this company ?

 

The company is called J E Baring and Co and non of our officers have a
connection to this company.

 

5.    Please provide a complete breakdown of the savings and precisely
where they have been made ?

No costing comparison has been carried out, therefore we do not hold this
information.

There is one case and we do not have an invoice as yet

Thank you for explaining that MKLT instructed J E Baring & Co, do you mean J E Baring & Co Limited that you referred to previously , and for Tunbridge Wells Council area cases only and none for the other council area's connected with MKLT.

Can you please clarify if these three separate occasions were for three separate individuals and please provide the dates, although I note you say you have not been invoiced yet for the third occasion, please list the amounts paid for the previous two cases.

Can you also confirm whether or not this out sourced work is tendered out ?

You say that you have relied on one officer's opinion to start instructing J E Baring & Co in September 2005, who within the council authorised this endorsement and granted one officer such power. Is this officer legally qualified to give an endorsement and please provide a copy of the endorsement.
