MHA s136
Dear Central and North West London NHS Foundation Trust,
Please provide me with the following detail per month for the period of January 2012 to the most recent month this year for which you have the data, preferably in Excel-compatile format, and in electronic format in any case:
(1) The list of NHS s136 suites, as defined in the the Mental Health Act (MHA), per borough covered by the trust.
(2) The list of NHS A&E departments, per borough covered by the trust.
(3) The breakdown, per s136 suite, of the number of days the s136 has been opened that month.
(4) The breakdown, per s136 suite and A& department, of the number of individuals detained under s136 of the MHA brought to each of the trust's s136 suites and A&E departments.
(5) The number of individuals detained under s136 of the MHA and admitted to hospital in the boroughs covered by the trust, following an MHA assessment.
(6) The breakdown, per s136 suite and A& department, by type of vehicle the individuals detained under s136 of the MHA were conveyed to that place of safety (i.e., ambulance, police vehicle, or other)
(7) The breakdown, per s136 suite and A& department, by gender of individuals detained under s136 of the MHA and conveyed to that place of safety.
(8) The breakdown, per s136 suite and A& department, by age range of individuals detained under s136 of the MHA and conveyed to that place of safety.
(9) The breakdown, per s136 suite and A& department, by ethnicity of individuals detained under s136 of the MHA and conveyed to that place of safety.
(10) The breakdown, per s136 suite and A& department, of whether individuals detained under s136 of the MHA and conveyed to that place of safety were considered to be suffering from the effects of drink or drugs
(11) The breakdown, per s136 suite and A& department, of whether individuals detained under s136 of the MHA and conveyed to that place of safety were restrained

Many thanks for your response, however, unfortunately some aspects of it are unclear and some cannot be read:
(a) In responses (4) and (7) you have not specified the period for which these numbers have been provided. Also, note that my original request asked for : 'the following detail per month for the period of January 2012 to the most recent month this year for which you have the data' so I would very much appreciate monthly breakdowns.
(b) In response (8) you mention an 'attached spreadsheet below' which you seem to have attempted to attach in response (9), however the only thing there's is an icon. Please provide this spreadsheet as a separate attachment.
(c) In response (11), you wrote: 'Whilst I cannot provide exact numbers it will average at more than one a month.' Do you mean that the average while more than one a month is also much lower than two a month (that would be the most logical interpretation considering your previous explanation that this is rare)?

In accordance with the FoIA and ICO's guidance on Using the Fees Regulations, can you please provide a reasonable estimate of the fees required to provide a monthly breakdown, and the basis for this estimate.

I responded very quickly because I had to be somewhere rather urgently and should have left the office.
On reflection I should have looked at the request again, I will now look at the original request again and see what I can provide.
I should be able to provide a monthly breakdown Trust-wide for Q4 if that is any help, however, I still believe that providing any additional breakdowns would put your whole request over the "Fees Limit".
At present I believe we have taken in excess of 15 hours, the fees limit for an organisation such as ourselves is £450.00 (18 hours @ £25.00 per hour).
If you are not happy with our action, then you need to go through the correct review process as outlined in my initial response letter.
