RE: Freedom of Information Request - FOI 1158

Dear Sir,

Thank you for your email requesting information held by Oxleas NHS
Foundation Trust regarding Section 136 Suites and Section 136 under the
Mental Health Act.

Please be aware, that Oxleas NHS Foundation Trust supplies Mental Health
and Community services to three London Boroughs: Greenwich, Bexley and
Bromley. As you will appreciate due to the wide remit, the Trust supplies
and provides numerous and varied services.

The Freedom of Information Act 2000 asks that any Freedom of Information
request is as specific as possible. If a request is too broad, the
responding organisation can ask for clarification which can delay the
process of providing the information requested.

It could result that due to the amount of information being sought, the
request could take the team collating the information over the limit set
out in the fees regulations under Section 12(1) of the Act. If so, a cost
estimate will be provided to you accordingly.  Under Section 12 of the
Act, the Trust does not have to make a precise calculation of cost to
comply with the request. We will however endeavour to provide the best
estimate possible if you wish us to do so.

As it stands your request is large but each question is specific in what
is being asked for. From your original request email, I understand that
you are requesting the following information with regards to Section 136
Suites per calendar month from January 2012 to present:

1. A list of Oxleas NHS Foundation Trust s136 suites per borough covered
by the Trust

2. The list of A&E departments per borough covered by the Trust

For question 2, could you please clarify whether or not you would also
wish to receive information regarding Urgent Care Centres

3. The breakdown per s136 suite of the number of days the s136 has been
opened that month

4. The breakdown for each s136 suite and A&E department of the number of
individuals brought in and detained under s136 of the MHA

5. The number of individuals detained under s136 following an MHA
assessment that were admitted to hospital in the boroughs covered by the
trust

6. The breakdown for each s136 suite and A&E department for the type of
vehicle used to convey the individuals detained under s136 to a place of
safety

7. The breakdown per s136 suite and A&E department for the gender of
individuals detained under s136 of the MHA that were conveyed to that
place of safety

8. The breakdown per s136 suite and A&E department for the age of
individuals detained under s136 of the MHA that were conveyed to that
place of safety

9. The breakdown per s136 suite and A&E department for the ethnicity of
individuals detained under s136 of the MHA that were conveyed to that
place of safety

10. The breakdown per s136 suite and A&E department of whether individuals
detained under s136 of the MHA conveyed to that place of safety were
considered to be suffering from the effects of drink or drugs

11. The breakdown per s136 suite and A&E department of whether individuals
detained under s136 of the MHA conveyed to that place of safety were
restrained

In your original request email you state you wish to receive the
information in Microsoft Excel format. Please be aware that Oxleas NHS
Foundation Trust only provides information for Freedom of Information
requests in PDF format.

In order for your request to be processed, clarify the point above with
regards to question 2 and also confirm that the rest of the questions
correctly detail the information you are requesting.

Your request will be placed on hold until clarification is received. Once
clarification has been obtained, I will begin to process your request.

If you require any further assistance please do not hesitate to contact
me.

Kind regards.

Dear Cidney Lucas,

Thank you for your prompt response. To answer your request for clarification I will need your s16 assistance.

With this request I am interested in data about individuals detained under s136 of the MHA. My understanding is that individuals detained under this section are brought to a place of safety and that means in practice either an s136 suite, an A&E department or occasionally a police custody suite (though this happens rarely for the MPS).

I am not familiar with Urgent Care Centres, so if these Centres are also used as a place of safety for individuals detained under MHA s136, then I would indeed very much wish to receive information about them as well. Otherwise, this would not be relevant to this project.

I also note that your response will be sent in PDF format. A spreadsheet format is easier to work with, but the choice of electronic format is yours to make.

Yours sincerely,

David Mery

Cidney Lucas,

I am out of the office from 23nd August 2013 and will be returning 27th August 2013. In my absence please contact Diane Parsons on 01322 299856 or Phil Warren on 01322 299854.

Philip Warren,

Dear David Mery,

I am dealing with your request in my colleagues absence.

In respect of your request and for clarity, the Trust does not provide A&E
services for the London Boroughs of Bexley, Bromley and Greenwich. Acute
Services are provided at present by South London Healthcare NHS Trust.
Oxleas provide Mental Health and Community services only.

To also clarify Urgent Care Centres are GP run services that would not
detain individuals under Section 136 of the Mental Health Act (MHA).

We need clarification on the term 'suites' in relation to section 136 of
MHA in your questions.

We need clarification on how you would like a 'breakdown' of the
information for each question.

We need clarification on the specific meaning of Question 3?

We need clarification on 'breakdown' by the 'age of individuals' you refer
to in Question 8.

Under Section 16 of the Freedom of Information Act, to assist you in your
request and for clarity to be able to ascertain if any information being
requested is held by the Trust, can you please reword and resend your
request, taking into account the information we have provided and
clarifications being sought.

We also require you to provide a template of how you wish this
information, should it be held, to be provided to you. This will then be
converted to pdf format if any information is provided.

Your request will now be placed on hold until we receive these
clarifications.

Yours sincerely

Dear Philip Warren,

Thank you for your clarification about 'Urgent Care Centres'.

Let me try to answer you further request for clarifications:

> We need clarification on the term 'suites' in relation to section 136 of MHA in your questions.

The meaning of the term 'section 136 suite' is as generally understood and in any case as per Lord Adebowale's Independent Mental Health and Policing Commission on Report. The MHA section 136 suites that the Oxleas NHS Foundation Trust likely operate should be the main designated places of safety where individual detained under MHS s136 are brought to, where an MH assessment will occur. Other places of safety include A&E departments and on some occasions (though rarely for the MPS) police custody suites. (The operation of Section 136 in London, An Action Plan to improve uses the expression 'designated place of safety' to refer to s136 suites.)

> We need clarification on how you would like a 'breakdown' of the information for each question.

Both monthly and per s136 suite.

> We need clarification on the specific meaning of Question 3?

The s136 may be closed down for periods of time. The most common reason is for repairs. It is of no use knowing which s136 suites the Oxleas NHS Foundation Trust operates if one doesn't know if they're operational during the period one is researching.

As I do not need to know on a day by day basis whether an s136 is open and operational, having the number of day each suite is open per month is a granularity that gives enough information.

> We need clarification on 'breakdown' by the 'age of individuals' you refer to in Question 8.

If you already have an age breakdown you're using, please use this one, otherwise, please use the following: 0 – 11, 12 - 16, 17 - 25, 26 - 35, 36 - 45, 46 - 55, 56 - 65, 66 - 80, 80+

> Under Section 16 of the Freedom of Information Act, to assist you in your request and for clarity to be able to ascertain if any information being requested is held by the Trust, can you please reword and resend your request, taking into account the information we have provided and clarifications being sought.

Please provide me with the following detail per month for the period of January 2012 to the most recent month this year for which you have the data in electronic format in any case

(1) The list of NHS s136 suites, as defined in the the Mental Health Act (MHA) and clarified above, per borough covered by the trust.

[(2) Not applicable]

(3) The breakdown, per s136 suite, of the number of days the s136 has been opened that month. (See clarification above.)

(4) The breakdown, per s136 suite, of the number of individuals detained under s136 of the MHA brought to each of the trust's s136 suites.

(5) The number of individuals detained under s136 of the MHA and admitted to hospital in the boroughs covered by the trust, following an MHA assessment.

(6) The breakdown, per s136 suite, by type of vehicle the individuals detained under s136 of the MHA were conveyed to that place of safety (i.e., ambulance, police vehicle, or other)

(7) The breakdown, per s136 suite, by gender of individuals detained under s136 of the MHA and conveyed to that place of safety.

(8) The breakdown, per s136 suite, by age range of individuals detained under s136 of the MHA and conveyed to that place of safety.

(9) The breakdown, per s136 suite, by ethnicity of individuals detained under s136 of the MHA and conveyed to that place of safety.

(10) The breakdown, per s136 suite, of whether individuals detained under s136 of the MHA and conveyed to that place of safety were considered to be suffering from the effects of drink or drugs

(11) The breakdown, per s136 suite, of whether individuals detained under s136 of the MHA and conveyed to that place of safety were restrained

- 65, 66 - 80, 80+

8. The breakdown, per s136 suite, by ethnicity of individuals detained
under s136 of the MHA and conveyed to that place of safety.

9. The breakdown, per s136 suite, of whether individuals detained under
s136 of the MHA and conveyed to that place of safety were considered to be
suffering from the effects of drink or drugs

10. The breakdown, per s136 suite, of whether individuals detained under
s136 of the MHA and conveyed to that place of safety were restrained

Once I receive confirmation from you that the above questions specifically
ask for the information you require, I will approach the appropriate Trust
Director/s to check whether or not the information is held by the Trust.
