The information requested relating to this contract was received by the University from a third party. It has the necessary quality of confidence in that it would not normally be made freely available or accessible to others particularly those who are potential suppliers.
The University can confirm that it was received through a tender process carried in a strictly confidential basis where bidders do not have access to the prices and information supplied by others. Having awarded the contract the University is contractually bound to maintain the confidentiality of information that would enable others to determine the prices of the supplies. The University considers that both the disclosure and the potential impact of the disclosure to the world at large would be detrimental to the confider.

Public interest test

Whilst s.41 is an absolute exemption, the duty of confidence contains an inherent common law public interest test. Unlike the other Freedom of Information public interest tests undertaken in respect of the other exemptions considered, s.41 has a presumption that the public interest lies in maintaining the confidence unless outweighed by the public interest in disclosure.

In respect of this, the University considers that the likely detriment to the supplier in respect of this matter, from the publication of the contract details requested, and the potential for action to be taken against the University for any breach of confidence as well as the likely long term damage on the University in respect of its ability to run a competitive tender process outweighs any public interest in the publication of the information on the basis of transparency.
