Dear Office of Fair Trading,

Can you point me in the direction of the legislation which allows Merseytravel to hold what I and the people of Merseyside consider to be a monopoly on the River Mersey crossings from Liverpool to Wallasey and Brikenhead. Secondly, has this organisation been investigated for holding this monopoly or are they exempt by virtue of being a government quango.

Dear Mr Rimmer


You made a request to the Office of Fair Trading (“the OFT”) on 3 March
2014 for information under the Freedom of Information Act 2000 (“the
FOIA”), in relation to Merseytravels monopoly of River Mersey crossings.
The deadline for OFT to reply to your request would normally be 1 April
2014. However the OFT will cease to exist at close of business on 31 March
2014, which is before the point at which the law requires that a response
is made to your request. The OFT functions to which your request relates
will be exercised by the Competition and Markets Authority (“the CMA”) as
from 1 April 2014.


The OFT will endeavour to ensure that, despite its impending closure, you
receive a response to your request. However, you should be aware that the
OFT’s information records are unlikely to be complete at this stage
because of the transfer of relevant information to the CMA, and to an
external file storage facility, in readiness for this transfer of


If it is not possible in the circumstances for the OFT to respond to your
FOIA request appropriately before it closes, the request will be treated
as having been made to the CMA, and passed on to that authority for
completion as soon as possible after 31 March. Please let us know if you
do not wish this to happen.
