the ICO.

"I would like a copy of all Judgements made by the ICO regrading
Merseyside Police Authority and Merseyside Police."

I should explain that the ICO does not make 'judgements' as such. In terms
of data protection complaints it can make assessments as set out at
section 42 Data Protection Act 1998 and in terms of freedom of information
complaints, can make decisions (and issue decision notices) as set out at
section 50 Freedom of Information Act 2000.

You can read decision notices issued to Merseyside Police on the ICO
website ([1]www.ico.gov.uk) by using the decision notice search facility -
you can search according to public authority and they are listed
alphabetically.

Therefore, with regard to freedom of information complaints made about
Merseyside Police this is exempt information under section 21 Freedom of
Information Act 2000 as the information is reasonably accessible to you
via other means (on the ICO website).

I hope this information is of some assistance to you.

We will, however, provide a further response relating to any data
protection complaints that may have been made about Merseyside Police. 

This part of your request is being dealt with in accordance with the
Freedom of Information Act 2000 under the reference number shown above.

I did not request info about Merseyside Police but Merseyside Police Authority as it clearly says on my request. You web site does not give the option of searching for Merseyside Police Authority.

I know that one was issued against Merseyside Police Authority.

So please conduct a review or fix your website.

I write further to our acknowledgement and to your email of 5 March 2012.
I am sorry for any confusion that has arisen; the acknowledgment of 2
March 2012 was not designed to be our definitive response but an
acknowledgment of your request and a pointer to some information that was
already available to you.
 
This response will hopefully provide a more complete picture. If you
remain dissatisfied with this response then you can request a review as
explained below.
 
Your request read:
 
“I would like a copy of all Judgements made by the ICO regarding
Merseyside Police Authority and Merseyside Police.”
 
We should reiterate that the ICO does not make ‘judgements’ but can issue
Decision Notices with respect to freedom of information complaints and can
make assessments with respect to data protection complaints.
 
As explained in our acknowledgement of 5 March 2012 all Decision Notices
are published on the ICO website. You can see that there are 2 Decision
Notices relating to Merseyside Police. As you point out in your email of 5
March 2012 there is not an FOI Decision Notice relating to Merseyside
Police Authority. We should point out that not every freedom of
information complaint results in a Decision Notice being issued and it is
only Decision Notices that are published on our website.
 
All ICO casework – data protection and freedom of information is recorded
on our casework management system. Further to this we have run a report
for all complaints made about Merseyside Police Authority and Merseyside
Police.
 
Please see a table attached detailing the complaints. We have run the
report for complaints made since April 2007.
 
The report includes a few ‘open’ cases and we must make clear that these
matters may not yet have been communicated to the data controller and may
not need to be. The outcomes are not yet decided and could be resolved in
any way.
 
As you will see there are data protection related complaints regarding
Merseyside Police Authority but there is not an FOI complaint that
resulted in a Decision Notice which is why such a Decision Notice does not
appear on our website.
 
Your focus appears to be on FOI Decision Notices and so we have not
provided copies of assessment letters made in data protection cases here.
However, if you would like us to consider these assessment letters for
disclosure please let us know.
